New Delhi: Gov’s recent arguments in the Supreme court against the practice of triple talaq and polygamy under Sharia law are likely to figure prominently in the Law Commission’s report on having uniform civil laws for all Indians irrespective of their faith or personal law, informed sources have said.Last week, in a 29-page affidavit to the SC, Centre said the practice of triple talaq and polygamy is unreasonable, discriminatory and denies gender justice enshrined in the Constitution. “We are studying the government’s response closely,” a member said.The commission last week had a full-strength meeting on issues pending before it, including a reference from the govt in June asking the commission to explore whether the time is ripe for enforcing common civil laws.“Law commission reports are read and referred in courts, they cannot be prepared in a hurry,”Law Commission chairman Justice (retired) Balbir Singh Chauhan said.“We will wait for the Supreme Court’s judgement on Triple Talaq and maintenance before completing our report,” he added. The commission has time until August 2018 to submit reports on matters pending before it.Currently, criminal laws in India are applied uniformly but different personal laws govern different communities in matters such as marriage, divorce and transfer of property. Ruling BJP has long argued for a uniform civil code.“The Supreme Court itself has said in the past that the time has come for uniform civil laws. The commission is involved in an academic exercise, studying the constitution and seeing if these practices are in consonance with it,” the member said. The panel is studying previous judgements.The panel has begun a 45-day exercise of seeking comments from the public and stakeholders on the matter. New Delhi: Strongly condemning Central government’s affidavit filed before Supreme Court that opposes practice of triple talaq and polygamy, Jamiat Ulama-e-Hind (JUH) called it NDA govt’s first move towards implementing Uniform Civil Code. Centre on Friday opposed the practice of triple talaq and polygamy in the Supreme Court and said it can't be regarded as an essential part of religion. Maulana Arshad Madni, President of Jamiat reacted sharply to Centre’s stand and said by interfering in Muslim Personal laws under the pretext of gender equality, the govt is making its way clear for implementing Uniform Civil Code. “Muslim Personal laws are based on Islamic scriptures mainly Quran and Hadees which cannot be replaced and hence there is no scope of interference in these laws. We reject govt’s stand opposing these laws that are prevalent in the country since its inception during British era. This is for the first time that Indian govt has opposed these laws and hence clearly reflects its ambition of implementing uniform civil code”, Madni said in a press release.He also said that Jamiat is the oldest Muslim body that was also functioning during country’s independence struggle and then it was agreed by Mahatma Gandhi and Pandit Nehru that minorities will be given freedom to practice their personal laws. “I am sure 99% Muslims in the country will want no interference in these laws. In an apparent snub to India, Chinese authorities have warned that no country should use counter-terrorism as a tool for “political gains”. Allahabad: A VHP activist and his business associate were thrashed and handed over to the police for allegedly donning a burqa and sneaking into a gathering of women at a place of worship on Sunday.The incident took place in Umarpur village, about 40 kms from Allahabad. Abhishek Yadav and his business partner Atif visited an Imambara, police station in-charge Satinder Singh said.He said Yadav, whose wife is a member of Zila Panchayat, had reached the venue allegedly wearing a burqa which enabled him to sit close to women. An outcry ensued when some people caught a glimpse of his jeans and sports shoes underneath the burqa, following which the men present at the Imambara ripped off his attire and beat him up, besides thrashing Atif who tried to intervene.According to Singh, Yadav, a member of the VHP, has been booked in the past for rioting and creating communal disturbances. A case was registered against him on Sunday.Meanwhile, a cross-complaint was lodged by Yadav’s brother, Veersen, who has alleged that “Abhishek and Atif were waylaid close to the Imambara by a group of marauders who brutally assaulted the duo and snatched away their valuables before dragging them to the police station and fabricating a story.”Police is investigating allegations made by both sides. the hindu

New Delhi:A group of youths clashed in east Delhi’s Trilokpuri on Saturday, following which police had to rush in reinforcements to ensure that violence did not escalate. Shopkeepers in the area downed shutters fearing the violence would escalate but the situation was brought under control within half an hour.Police said six CCTV cameras and 2 lamp posts were damaged in the stone pelting. A case of rioting has been registered.The clash was reported from outside the Madina Masjid Chowk, located between blocks 29 and 32, in Trilokpuri.Police said that the incident took place after a 23-year-old man was beaten by a group of youths at around 8.30pm. Locals said the clash escalated and two groups of Hindus and Muslim youths pelted stones at each other. The situation at present was under control and the police claimed that on Saturday night they had reached the spot within 20 minutes of the incident being reported. Ahmedabad: Ex-Gujarat High Court judge, Justice (retd) Behram Jahanbux Sethna, Sunday said terrorism was not just perpetrated by terrorists, but also by the judiciary in the country. Justice Sethna had hit the headlines in Jan.2004, after a 2-judge bench headed by him had upheld the judgment of the Vadodara fast-track court, acquitting all the 21 accused in the Best Bakery case in which 14 people were burnt alive during the post-Godhra 2002 riots. But the Supreme Court rejected his judgment, ordering a fresh trial by a special court in Mumbai, and the accused were finally punished. He was speaking at the launch of the NGO, Justice for Victims of Terrorism (JVT), a brainchild of ex-IPS officer DG Vanzara, an accused in the Sohrabuddin Sheikh and Ishrat Jahan encounter cases, and other retired IPS officers, including former Gujarat DGP SS Khandwawala, KP Raghuvanshi, among others. NGO aims to “provide financial and legal aid to victims of terrorism as well as to family members of the accused named for terror activities”.Referring to the reversal of his judgment by the Supreme Court in the Best Bakery case, he said, “Terrorism sirf terrorists hi nahi karte, judicial terrorism bhi hai.
