Modi govt exploring law on banning beef & cow slaughter

New Delhi: Setting the ball rolling for a possible law banning beef and cow slaughter, the Union environment ministry has asked the agriculture ministry to explore the option of enacting a national law to prohibit slaughtering of cow, selling of beef or beef products. Anil Madhav Dave-led ministry of Environment, Forest and Climate Change (MoEFCC) sent a letter to this effect to Union agriculture ministry’s Department of Animal Husbandry, Dairying and Fisheries (Cattle Division) on 23 Dec. Mint has reviewed a copy of the letter.It is not the first instance when protection of cow, considered holy by a section of Hindus, is in news. Since May 2014, when the NDA govt led by BJP assumed power, there have been several occasions when the issue of cow protection has been in the limelight.MoEFCC letter seems to be in response to a July 2016 judgment by the Himachal High Court asking the Central govt to, “enact the law prohibiting slaughtering of cow/calf, import or export of cow/calf, selling of beef or beef products, in its wisdom, at national level”.“In view of the fact that slaughtering of cow/calf, import or export of cow/calf, selling of beef or beef products and related matters fall under the administration of Department of Animal Husbandry, Dairying and Fisheries (cattle division), it is required that necessary action in the matter may kindly be taken,” said the MoEFCC letter.Meanwhile, there have been demands to declare cow as India’s national animal replacing tiger. The home ministry has discussed ways to check cattle (mainly cows) smuggling to Bangladesh. The environment ministry has also asked the Animal Welfare Board of India to assess the cost of building new cow shelters and maintain existing ones to house stray cattle across India. livemint

New Delhi: Fabled Narendra Modi-Barack Obama friendship may have been just for the cameras. According to a report in Pak newspaper Dawn, the US has started the process for “peacefully” resolving the Indus Waters dispute between India and Pakistan. The report says the US has taken the initiative on its own without “waiting for an invitation to do so”.Meddling in the Indus Waters Treaty dispute is latest act of the outgoing US administration to unsettle bilateral relationship with “friendly” countries.Last week, US Secretary of State John Kerry had irked his country’s all-weather ally Israel by suggesting a “2-state” solution to the Israel-Palestine conflict and claiming that the Jewish state was ruled by “most right-wing govt” in its history. Kerry had attacked Israeli PM Benjamin Netanyahu for settlement-building, accusing the latter of dragging Jewish state away from democracy. Re-promulgation of ordinances is 'fraud' on Constitution: Supreme Court

New Delhi: The Supreme Court has held that re-promulgation of ordinances without being placed before the legislature was constitutionally impermissible as it amounted to bypassing the legislative body which was the primary source of lawmaking authority in a parliamentary democracy. A 7-judge constitution bench held that govt's decision to bring ordinance can be reviewed by judiciary and said that it was obligatory on the govt to place the ordinance before the legislative body for its approval. Failure of govts, at the Centre as well as states, to place ordinances before Parliament and state legislatures would itself constitute a fraud on the Constitution.The majority verdict, by Justices AK Goel, UU Lalit, DY Chandrachud and L Nageswara Rao, held that "re-promulgation defeats the constitutional scheme under which a limited power to frame ordinances has been conferred upon the President and governors". "The danger of re-promulgation lies in the threat which it poses to the sovereignty of Parliament and the state legislatures which have been constituted as primary law-givers under the Constitution. Open legislative debate and discussion provides sunshine which separates secrecy of ordinance-making from transparent and accountable governance through lawmaking," it said.Chief Justice TS Thakur, who was heading the bench, also agreed with majority verdict on the issue but differed on one aspect. "I am in complete agreement with the view expressed by my esteemed brother Chandrachud,that repeated repromulgation of the ordinances was a fraud on the Constitution especially when the govt  of the time appears to have persistently avoided the placement of the ordinances before the legislature." CJI, however, questioned whether it is mandatory for the govt to place the ordinance before legislative body saying that the matter should be examined in a separate proceeding. The court said that SC's `hope and trust' that lawmaking through re-promulgated ordinances would not become the norm had been belied by successive govts.TOI

Kancha Ilaiah, a prominent writer and political scientist based in Hyderabad, told Al Jazeera that the inclusion of caste in the Supreme Court judgement was "unfortunate". "Verdict said mobilising voters on the basis of caste, race, language and religion amounted to corruption," he said. Ilaiah, who belongs to the Dalit caste, India's so-called lowest caste, said the judgement undermines the ability of his social class to use politics as a means for their upliftment."The SC now says we cannot use the caste issue for our liberation, for our equality. If they say that, then how do we achieve our liberation? What about the right to speak about my oppression?" Ilaiah said. "It is as if the SC has said [our enslavement] cannot be used as an instrument to fight back," he added.However, Ilaiah believes the judgement means that parties like BJP could no longer openly intimidate minorities or use "Babri [a demolished mosque] or beef as part of their electioneering". New Delhi: Differing with the majority, 3 judges on the Constitution Bench invoked “histories of discrimination and injustice” on the basis of religion, caste, community to argue that candidates should not be barred from addressing their “legitimate expectation” that deprivation due to these “immutable characteristics” will be remedied through the electoral process.Stating that issues of religion, caste, etc. “are crucial to maintaining a stable balance in the governance of the nation,” the minority view in the 4-3 judgment said that “the spirit of discussion, debate and dialogue sustains constitutional democracy” and “a sense of inclusion can only be fostered by protecting the right of citizens freely to engage in a dialogue in public spaces”.Deliberation on religion, caste, etc. is the affirmation of “constitutionally protected values and…an intrinsic part of the freedom of speech and expression”, held the minority view, and warned that imposing a prohibition on electoral discourse on issues pertaining to caste, race, community, religion or language might reduce democracy to “an abstraction” apart from restricting the fundamental right of freedom of speech and expression of candidates.Describing caste, race, religion and language as “matters of constitutional importance,” the minority judgment, authored by Justice D Y Chandrachud on behalf of himself and Justices Adarsh K Goel and Uday U Lalit, said that discussion of matters relating to these identities which are of concern to the voters is not an appeal on those grounds. The Supreme Court verdict on the misuse of religion and caste by political parties has sent ripples among the political parties in poll-bound Punjab, where sacrilege is an issue, and radical Panthic outfits have also decided to field candidates.While the Congress called the judgment a blow to the ruling party, Shiromani Akali Dal (SAD), the latter sought to downplay it by saying they had never used religion to seek votes.Referring to the SC verdict that politicians can’t use religion, caste, creed or language for seeking votes, state Congress president Captain Amarinder Singh said the order has far reaching implications for Punjab where the Akalis have always misused religion to seek votes. He said even today, Akali leaders were taking people to gurdwaras and making them swear their support to the SAD.Amarinder alleged that many Akali leaders were holding ‘ardaas’ outside gurdwaras to influence people to cast their vote on basis of their religion. He also accused the Akalis of misusing Sikh Gurdwara Parbandhak Committee (SGPC) for electoral purposes.The SAD, however, put up a brave front on the issue. “There is no doubt that the SAD is a party for which Sikhism is a core value and politics and religion in Punjab are in a way inseparable. But it is a disciplined party and has never used religion, caste, etc for elections. We never seek votes in the name of religion. Mumbai:BJP has filed a complaint against AIMIM President and MP Asaduddin Owaisi over his controversial speech at a public meeting in Mumbai saying that the speech sought to provoke communal tension in the city. Owaisi had stated if people support the AIMIM, he would try to approve special budget for Muslims worth `6,770 crore. “Owaisi’s speech was aimed at inciting communal tension and to disturb the law and order situation in the city. The demands made in the speech are completely illegal. New Delhi: Continuing with its spate of show-cause notices, JNU administration has now issued a notice to student union president Mohit Pandey warning him of action if the protests at the administrative block are not stopped. Following chaos in Academic Council (AC) meeting, the administration has also sought police presence for the Executive Council (EC) meeting scheduled today. 9 students were suspended for allegedly "disrupting" the AC meeting along with a teacher who was served notice for addressing them."The series of show-cause notices and suspensions are just an attempt by the administration to attack the student unity and destroy the protest culture at the varsity. Agra: Students of AMU took out a protest march on Monday against what they termed as a "brutal attack" on them by police during their rail blockade programme on Dec.31. Raising slogans against UP police and carrying placards "AMU stands against injustice" and "UP police murdabad", the students submitted a memorandum to CM  Akhilesh Yadav, through local administration demanding action against the police personnel.Nabeel Usmani, secretary of AMU, said we were proceeding towards the railway platform peacefully to protest against the failure of the police in tracing missing JNU student Najeeb Ahmad, when police resorted to unprovoked lathicharge, leaving several students injured.Dubbing the police action as "unjustified and undemocratic", Usmani said such treatment is not acceptable. Noida: Ex-Foreign Minister Yashwant Sinha, who recently led a group of concerned citizens to Kashmir, was hopeful of resumption of a formal dialogue between Kashmir and New Delhi soon and has sought an appointment with PM Narendra Modi to deliberate on the issue. The senior BJP leader claimed that he had meetings with several senior functionaries in the NDA govt  and is doing ‘front ground work’ to resume a formal dialogue process soon. Jammu: In the much publicized PIL related to setting up of Minority Commission in J&K for extending benefits available to minorities, the Centre and State Govt  suffered a major blow when the Supreme Court of India on Monday imposed costs of Rs 15,000 each for not filing their reply in time.The apex court has directed payment of Rs 30,000 to the petitioner Ankur Sharma. It gave two weeks’ time to the Union and the State govt s to file their responses.On Monday, when the much publicized matter in WPPIL No. 489/2016 titled Ankur Sharma V/s Union of India and Ors. seeking identification of religious and linguistic minorities in the state of J&K, came up for hearing, Advocate Sharma (petitioner-in-person) strongly pressed for the suspension of minority schemes illegally being implemented in the State for the reason that the Central NCM Act is not applicable to the state of J&K and the majority community of the state is illegally reaping the benefits of more than 50 minority schemes. Hyderabad: High Court on Monday admitted the appeal filed by the 5 convicts of the Dilsukhnagar bomb blast and would hear it along with the reference proceedings of the Special NIA Court for confirmation of the death sentence awarded to the convicts.While admitting the matter, the bench comprising Justice C V Nagarjuna Reddy and Justice M S K Jaiswal said that it will hear the appeal along with the case records and the file referred by the NIA Court for confirmation of the sentence. On Dec 19, the special court imposed death sentence on the convicts - Yasin Bhatkal, Asadullah Akhtar, Zia Ur Rahman, Mohammed Tahseen and Aizaz Saeed Shaik - who were found guilty of carrying out the blasts. newindianexpress

Mumbai: With the office-bearers of banned IRF untraceable, the Mumbai Police has not been able to serve a notice on it to appear before a judicial tribunal that was formed to look into the ban. After the Central govt notified the UAPA comprising Delhi High Court Justice Sangita Dhingra Sehgal to adjudicate whether there was a just cause to declare IRF as an ‘unlawful association’, the tribunal issued a notice to the IRF to appear before the tribunal on Feb.6. Tribunal has given televangelist Zakir Naik’s IRF 30 days to provide its written objections to the ban.However,Mumbai Police has only been able to paste a copy of the notice at the IRF office on Tandel Street in Dongri. The office has been shut ever since the organisation was banned by Union Ministry for Home Affairs in Nov.Officers at the Dongri police station have spent the last week tracing home addresses of IRF’s office-bearers after the tribunal was not satisfied with its initial efforts. “At first, we served a copy of the notice on IRF’s lawyer Mubin Solkar. But the tribunal has instructed us to serve copy only to the office-bearers,” said a polcie officer. Since then, the local police have been making announcements on loudspeakers in Dongri hoping to gain attention of the organisation’s members. Panaji: 2 persons, who were arrested after they were found distributing pamphlets about a programme by NGO of Zakir Naik, do not have terror links, Goa police said on Tuesday. Abdul Nasir and Iliyaz Ismail were held last night at Dona Paula beach in Goa as they were distributing pamphlets about a programme by Naik’s NGO in Mangalore.“We have interrogated the two over the night. We have found that they have no terror links. They had come to Dona Paula beach with their family,”SP (North) Umesh Gaonkar said.He said the duo was in possession of the pamphlets canvassing for a convention of Salafi Muslims to be held in Mangalore from Jan.9-16. Ismail is a resident of Margao where he has been living for over a decade, while Nasir is his brother-in-law, who is from Kasargod (a village in Kerala), the SP said.He said ATS, IB and Special Branch teams interrogated accused while Margao police was also asked to get details about them.PTI

2008 Malegaon blasts: Court allows NIA to use copies of missing documents as evidence

Mumbai: A special court has allowed NIA to use available copies as secondary evidence in place of papers that have gone missing in the 2008 Malegaon blasts case. In April last year, the special NIA court had been informed that some original documents that were part of the evidence were untraceable. These included 13 witness statements recorded by Maharashtra ATS under Section 164 of Criminal Procedure Code and two statements of the accused recorded under the MCOCA.In Sept., NIA, which took over the probe in 2011, had approached the court seeking permission to use photocopies of the original documents. The accused, including Lieutenant Colonel Prasad Purohit, had opposed the plea, stating they had been provided truncated copies, and their authenticity was not verified.Special public prosecutor Avinash Rasal said the court observed that among the documents were various statements available with the investigators, including the ATS and the NIA. Case is at the stage of framing of charges against the 11 accused, including Sadhvi Pragya Singh Thakur, Major Ramesh Upadhyay, Sameer Kulkarni and others.indianexpress

Lucknow: In middle of a war as to who will control the Samajwadi Party, Akhilesh Yadav today visited father Mulayam Singh Yadav at his home in Lucknow hours after the phone call between the father and son this morning.  Mulayam Singh Yadav took a chartered flight from Delhi to Lucknow this morning. With support of thousands of party members, Akhilesh Yadav replaced his father as party chief, report by NDTV stated. The Yadav family has dragged their party into a crisis just when UP gears up for the upcoming 2017 elections. The relationship between father and son has soured to the extent that it has Election Commission ahead of the crucial assembly elections in the state. It looks unlikely that the Election Commission will be able to solve the feud in the family in time for UP elections. The Samajwadi Party may come up with a new attempt at finding a truce after the father and son phone call this morning. As per report, Mulayam Singh has so far not expelled the CM  from their party.

New Delhi: With no significant changes in the socio-economic conditions of the Muslim community even 10 years after Sachar Committee report accepted by the central govt , social groups, community leaders and academicians say the intention of Govts is the main factor behind the backwardness of Muslims in the country. At a program titled “10 Years of Justice Sachar Committee Report - A Review” held here, they urged the govt to implement the Sachar Committee recommendations with honest intention to uplift the community and other minorities. Prof. Manoranjan Mohanty of Delhi University said:"There were two major recommendations (of Sachar Committee). First, diversity index to be applied in all public and private organizations. This is still on paper only. Unless we really apply this index we don’t realize whom we are missing out. Second was to set up a National Data Bank. We still don’t know whether govt has any policy about this yet.The present govt has in fact almost dropped Right to Education Act. Guwahati: 3 lesser known northeast rebel outfits mentored by hostile-again National Socialist Council of Nagaland-Khaplang (NSCN-K) and the Paresh Barua faction of United Liberation Front of Asom (Ulfa-Independent) have set March 31 as deadline for Hindi speakers and Bengalis to quit Tripura and parts of Assam and West Bengal.These outfits are Kamatapur Liberation Organisation (KLO), National Liberation Front of Twipra (NLFT) and People’s Democratic Council of Karbi-Longri (PDCK). They have been provided a new lease of life by the Myanmar-based United Liberation Front of Western South East Asia, a front helmed by NSCN-K and Ulfa-I. Hindi speakers, seen as representatives of ‘colonial New Delhi’, have been pet targets of major extremist groups in the Northeast. Bengalis have been added to their hate list in reaction to BJP’s plan to grant refugee status to persecuted non-Muslims from neighbouring countries, primarily Bengali Hindus from Bangladesh.

Russia is to host a meeting for the major Palestinian factions on 15 January, local news agency TASS reported. Russian news agency said that senior PLO official Wasel Abu Yousef told the Israeli newspaper the Jerusalem Post about this planned meeting.Quds Press also reported a senior Palestinian official discussing the meeting.
