PIL for change in Muslim inhertance law: Delhi HC seeks Govt reply

New Delhi:Delhi High Court today sought the govt s response on a plea to amend the Muslim personal law on inheritance alleging that Muslim women were discriminated on issues relating to sharing of property.A bench of Chief Justice G Rohini and Justice Sangita Dhingra Sehgal issued notice to the govt  and directed it to examine the issue regarding alleged discriminatory practice in the Muslim law with regard to inheritance.The court asked the govt  to submit its response before May 15, the next date of hearing.The court was hearing a plea by a social organisation -- Sahara Kalyan Samiti-- which has sought equal inheritance rights for Muslim women. The petition, filed by advocates Raghav Awasthi and Shoumendu Mukherji, alleged that Muslim women in India have been discriminated as far their rights of inheritance are concerned, in comparison to their male counterparts.It said that the discrimination based on customary law as well the present statutory law was violative of their fundamental right to equality enshrined under Articles 14, 19, 21 and other relevant provisions of the Constitution.The plea contended that Article 13 of the Constitution includes personal laws, including Muslim personal laws. "It is erroneous to assume that personal laws are excluded from the ambit of judicial examination," it said. The plea states that a bare perusal of the law shows that a wife shall receive 1/8th of the property of her husband on his death if they have children. In case there are no children borne out of the marriage, she is entitled to 1/4th of the property.A daughter shall receive half of the share of a son.In stark contrast, the men shall receive 1/4th of the property of his wife on her death if they have children. In case there are no children borne out of the marriage, he is entitled to half the property. A son shall receive double the share of the daughter, the plea contended.
"Thus, it is clearly perceivable that women under the present Islamic law in force are, by the mere factum of their being women in the nature of a wife or a daughter, are only entitled to half of the share of their male counterparts," it added. PTI

Delhi: BJP leader Shazia Ilmi on Wednesday accused Jamia University of putting “pressure” on organisers of an event to drop her name from a panel of speakers for a seminar on triple talaq, a charge denied by the varsity.According to Ilmi, she was invited by RSS supported Forum for Awareness of National Security (FANS) to speak at a seminar on “Triple Talaq” and the university had pressurised the organisers to change the subject to “Muslim’s women’s empowerment: Issues and challenges” and drop her name from the speaker’s list.The forum, which has RSS ideologue Indresh Kumar as its patron, confirmed the sequence of events even as Jamia Millia Islamia authorities rubbished the allegations.“ Event was not organised by the university or any of its department. The auditorium was rented out to the organisers and in such events the varsity has nothing to do with either the subject or choice of the speakers. It was not our prerogative,” a Jamia spokesperson said, denying allegations of pressurising the organisers. Programme convenor Shailesh Vats, however, said, “We had finalised the speakers and the subject but then we were advised by the university to make some changes saying the atmosphere in the universities is not conducive to have such a discussion.”PTI

New Delhi: PM  Narendra Modi will visit Israel by the middle of this year, the first by any Indian PM  to the Jewish nation.The visit is likely to take place sometime in June. Govt sources said the visit would “take place this summer”, with preparations already having commenced as both sides are working out the dates for the visit along with other details. Israeli PM  Benjamin Netanyahu is also likely to visit India by the end this year.The two nations on Tuesday unveiled a logo in the capital to mark 25 years of diplomatic ties. Speaking on the occasion, MEA’s secretary (economic relations) Amar Sinha said although both the countries have cooperation in the defence and the security sectors, “conscious” efforts are being made to make it a “multi-dimensional relationship”, and not merely “unifocal”.Israeli ambassador Daniel Carmon said the two sides are working on “every possible area of cooperation”. In the past 13 years, India has bought weaponry and defence platforms worth billions of dollars from Israel. Sinha said the two countries have planned a series of events to celebrate the silver jubilee of the diplomatic relationship this year. It has been decided “at the highest level”, to create joint coordination committee to plan out the activities. This includes visits by business delegations, academic fora. After the mysterious dissapearnace of the JNU student, Najeeb Ahmed, a proctorial enquiry conducted by JNUfound ABVP member Vikrant Kumar guilty of assaulting Najeeb Ahmed during a brawl over a month ago, a day after which Ahmed went missing.“In the proctorial enquiry, Vikrant Kumar has been found to be involved in hitting Najeeb Ahmed and using derogatory language with provocative behaviour on Oct 14. This is an act of indiscipline and misconduct,” an official order read. New Delhi:Delhi Police on Wednesday said that a peaceful protest was being carried out by the students in the JNU.However, university authorities alleged that the protestors were blocking the administrative block in the campus.When the matter came up for hearing before the Delhi High Court today, the police submitted a report stating that the students were holding a protest 50 metres away from the administrative block. "V-C, teachers and staff of JNU are using the administrative block without any hindrance. Everything is smooth there and even there is over 300 officials from the JNU security," the Delhi Police counsel told the High Court.ANI

New Delhi: Delhi Police have reportedly not found any comprehensive evidence to pursue its sedition case against former JNU president Kanhaiya Kumar. On Feb.9 last year, Kanhaiya was jailed on charges of sedition, along with JNU students Umar Khalid and Anirban Bhattacharya, who are currently out on bail. The police, however, are likely to indict Khalid and Bhattacharya, according to a draft charge-sheet accessed by TOI.The charge-sheet draws evidence from forensic reports of nearly 40 video clips that prove anti-national slogans were raised at JNU, Delhi, last Feb. Delhi Police have proof that Khalid had ‘anti-India’ posters designed to voice support for Afzal Guru. Videos capture around 140 protesters raising ‘anti-India slogans’, of which nine “outsiders”, from Kashmir, have been identified. Their statements were recorded by police in exchange for immunity.The charge-sheet does not cite Kanhaiya Kumar as a participant of the event, but says he did nothing (as JNUSU head) to stop students sloganeering. TOI reports that police will leave it up to the court to decide if charges need to be framed against Kanhaiya. In his defence, Kanhaiya, speaking to India Today, said he was not the permitting authority to allow or disallow an event. “The administration – (proctor or vice chancellor) issues permission for an event and not the JNUSU president. I don’t have the authority to allow or disallow events on campus,” he said.The final charge-sheet, filed under Section 121 A (sedition) and criminal conspiracy, will be submitted to the Delhi High Court after it is authorised by the police commissioner. indianexpress

Mumbai:Registrations for NEET 2017 end today — though the ambiguity over whether health science aspirants from Urdu-medium junior colleges can sign up remains unaddressed. Members of the Students Islamic Organisation (SIO) had requested the CBSE and the Medical Council of India (MCI) to postpone the deadline for NEET registrations by a few days, to accommodate students from Urdu-medium junior colleges. The fate of these students hangs on a petition, which the Supreme Court will hear on March 3.Last week, the Supreme Court refused to hear an urgency motion filed by SIO, pleading with the court to include Urdu as a language in which students can appear for NEET.“CBSE has excluded Urdu from NEET. Maharashtra state board, too, will not conduct a separate medical entrance test for courses other than medical and dentistry. Kolkata:The names of BJP's national general secretary Kailash Vijayvargiya and West Bengal women’s wing president Roopa Ganguly have been mentioned by the key accused in a child trafficking case.Chandana Chakraborty, who ran a child care home in north Bengal, said that Juhi Chowdhury, a general secretary of State BJP’s women’s wing, perhaps spoke to Vijayvargiya and Ms. Ganguly to “resolve some issues” about the child care home.Ms. Chakraborty told journalists in Siliguri before being produced before a local court, “I have not spoken to anyone [central BJP leaders]. Juhi spoke to them and perhaps to Roopa Ganguly and Kailash Vijayvargiya. Now, the wedding would be as per Arya Samaj rituals and would be solemnised in Indore. Latehar:A silent and unique social transformation is sweeping the Muslim community in Jharkhand’s Palamu region, with hundreds of families returning dowry they had taken during their sons’ weddings.Over the last one year, around 800 families came out in the open about accepting dowry and have subsequently returned the money. To date, over Rs 6 crore in cash has been returned to the brides’ families.This process kicked off once Haji Mumtaj Ali, a native of Pokhari village in Latehar, launched a campaign against dowry in April last year. Following his footsteps, the community elders waged a war against dowry, a social evil plaguing the lives of thousands of families, especially the poor. ‘Maulvis’, too, resolved not to solemnise ‘nikah’ where any exchange of dowry was involved. “The success of our campaign against dowry is astounding. So far, over 800 grooms’ families in Latehar and Palamu districts have returned Rs 6 crore in cash to the brides’ families. More importantly, the marriages are now being solemnised without any exchange of money,” said Ali, who was busy preparing for a massive community meeting at Daltonganj on March 7.“The war against dowry will eat up poor families like cancer till it is completely wiped out. There are still a few families who are yet to give up the evil practice. Earlier, the Muslim community did not pay dowry, but of late, dowry has become a part of marriages, in the process badly hampering the sanctity of this sacred bond,” Ali said.“We will also devise a strategy during the next meeting to tackle such families,” he said.HT

Chennai: Tamil Nadu Traders Association's call to shopkeepers to boycott US soft drink brands Pepsi and Coca Cola and sell only local brands evoked a partial response on Wednesday.The association took the decision to boycott Coke and Pepsi during the pro-jallikattu protests in the state in January as US-based NGO People for the Ethical Treatment of Animals (PETA) was responsible for the Supreme Court ban on the bull-taming sport. "PeTA was responsible for the ban on jallikattu. That is why we decided to boycott American soft drinks in the state starting March 31," said an official of the traders' association.The association said the two US companies were drawing plenty of water, and this has affected water sources of people and crops.Most small traders in North Chennai, Trichy and Salem stopped selling Pepsi and Coke in response to the boycott call. In Salem, shopkeepers stopped selling Aquafina too, a drinking water brand from PepsiCo.
