New Delhi: Chief Justice of India JS Khehar on Friday compared the practice of instant divorce in Islam to capital punishment, saying it was like death penalty – “abhorrent but still allowed”.The country’s top judge was responding to a submission by senior Congress leader Salman Khurshid, who said triple talaq was sinful but lawful. Khurshid is the amicus curie, or court’s adviser, in the case.A 5-judge constitution bench led by the CJI is hearing pleas challenging triple talaq which allows a Muslim man to end his marriage by uttering the word talaq (I divorce you) thrice in one go. vSeveral Muslim women have challenged triple talaq, saying it was discriminatory, against gender justice and dignity of women.“Can something which is considered abhorrent by religion be validated by law?” justice Kurian Joseph said in reaction to Khurshid’s remarks.Appearing for 3 Muslim women, senior advocate Ram Jethmalani said triple talaq was abhorrent. It discriminated on the basis of sex as it didn’t give women equal right to divorce.He also sought to link the divorce custom, largely followed by Sunni Muslims, with the larger debate over religion, saying secularism was subjection of religious doctrine to the rule of law.Jethmalani, who is also representing the Forum for Awareness of National Security, called for a uniform code of marriage for men and women of the same religion. The court commenced hearing the case on Thursday, which would have been the first day of its summer break. The court plans to wind up the hearings by May 19 and a judgement in the case, which can have a bearing on how personal laws, is expected in June.The multi-faith bench of five judges - a Hindu, a Sikh, a Christian, a Zoroastrian and a Muslim – had on Thursday made clear it would not examine the Islamic custom of polygamy and nikah halala while hearing petitions against triple talaq.Some of the petitioners had asked the court to scrap all the 3 practices. The bench has sought suggestions on the broad parameters of the directions the court may issue while deciding the validity of triple talaq.India has separate sets of personal laws for each religion governing marriage, divorce, succession, adoption and maintenance. While the Hindu law overhaul began in the 1950s and continues, activists have long argued that Muslim personal law has remained mostly unchanged. HT

New Delhi (PTI) Banning triple talaq will "not benefit" Muslim women, vice-president of All India Muslim Personal Law Board Maulana Syed Jalaluddin Umari today claimed, amid a raging debate on the issue. "Even if tripe talaq is outlawed, those who want to trouble their wives will still continue to do so and stop giving conjugal rights to their wives. This will lead to many complications and jeopardise the womans stature and dignity," he said. Incidentally, the Supreme Court today said it would examine whether the practice of triple talaq among Muslims is fundamental to their religion, but it may not deliberate upon the issue of polygamy as it began hearing petitions challenging the practice. Umari, also president of Islamic forum Jamaat-e-Islami Hind (JIH) reiterated that the problem of divorced Muslim women has been "blown out of proportion and statistics dont support the claim of this problem being endemic within the Muslim community". National Convener of Muslim Personal Law Awareness Campaign Muhammad Jafar also briefed about the campaign during the press conference. The pan-India campaign ran from April 23 to May 7."The objective of the campaign was to create awareness within the Muslim community regarding their personal laws as well as to remove the misconceptions and misgivings among fellow countrymen regarding the family laws in Islam that are related to the way Muslims marry, divorce and inherit," he said. New Delhi: If triple talaq is banned, it would be a major victory for the BJP, which has been energetically campaigning against it. The party’s strategists feel that the move has already made BJP closer to the Muslim women and consolidated the support of it’s core constituency — Hindutva vote across the vote bank. Minority affairs minister Mukhtar Abbas Naqvi on Thursday asserted that triple talaq “was not a religious issue but related to social ills” and that the debate on the issue would have a “positive bearing on the (Muslim) community and the country.” Mr Naqvi also said that the Modi government, which will be  completing three years later this month, has zero tolerance for communal incident and its policies are aimed at providing “empowerment (to minorities) without appeasement.” He also listed various achievements of his ministry in last three years and also announced that the government would launch ‘Tehreek-E-Taalim (campaign for education)’ on the birth anniversary of former President A.P.J. Abdul Kalam on Oct 15.However, All India Muslim Majlis-e-Mushawarat (AIMMM) President Navaid Hamid  claimed that the issue is religious as the practise is a part of Islam and the petitions against it are politically motivated.  While asserting that triple talaq is part of Muslim personal law, All India Muslim Personal Law Board (AIMPLB) member  Zafaryab Jilani also said that its misuse is a sin.Asian Age

Lucknow/New Delhi: It was supposed to be a day of spreading awareness and starting discussions on triple talaq across thousands of mosques in India to prevent misuse of the controversial Islamic divorce practice.Instead, the publicity campaign ran out of steam on its opening day with hardly any mention of triple talaq before Friday prayers across cities.Clerics pinned the blame on the All India Muslim Personal Law Board (AIMPLB) that had announced the initiative, saying it didn’t print and circulate a two-page booklet containing the code of conduct for Muslims on marriage and divorce. The body had distributed the document with much fanfare during its executive committee meeting in Lucknow on April 16.With the exception of one of Lucknow’s 1,000-odd mosques, the controversial issue that has divided the country found no mention in any sermon. Even the revered Nadwa mosque, which can hold 5,000 worshippers and was packed on Friday, saw little discussion.“I usually make it a point to attend Friday prayers at this mosque. But I heard nothing about any code of conduct from the Imam,” said Rehan Khan, owner of a furniture shop in Kaiserbagh locality.In Delhi’s iconic Jama Masjid, devotees said triple talaq found no mention during Friday prayers led by Shahi Imam, Syed Ahmed Bukhari.“Khutbas (seroms) are delivered in Arabic. Most of the people who offer prayers behind the Imam do not understand the language. I could not hear any mention of talaq in the khutba,” said Mohd Zeeshan. The courtyard of the mosque can accommodate at least 20,000. While Shahi Imam was not available for a comment, his spokesperson Ammanullah Bukhari said there was no such mention in the sermons before prayers.The board said the booklet couldn’t be printed in time because of errors in text. “We have vetted the format only yesterday (Thursday). We are getting calls from our various state bodies and cities for the booklet,” said board secretary Zafaryab Jilani.He added that the document would be printed in a number of local languages and also distributed in the upcoming AIMPLB session at Bengaluru on April 29.In the absence of the booklet, the discussion evoked little enthusiasm. In Jaipur, devotees who came to offer prayers at the Jama Masjid in Johari Bazaar were unaware of any AIMPLB directive. In his 25-minute sermon, the Imam only talked about the advantages of drinking cold water in the summer, according to a devotee, who attended the prayers.“We are yet to receive the booklets,” said Maulana Shafique Qasmi, the imam of Nakhoda masjid in Kolkata. The same was the response from another mosque in Rajabazar locality. “But I have got the directives on WhatsApp, and have circulated them among some people,” said Maulana Shafique Qasmi .In Patna, however, some clerics gave a brief talk on Muslim personal law. “We are going to start an awareness campus among the Muslims about Muslim personal law, what are the provisions related to marriage, talaq (divorce), rights of children,” said Ahmed Ali Akhtar, convenor of Jamaat-e-Islami Hind, Bihar.HT

New Delhi:In an unexpected U-turn, NIA informed the Supreme Court that it doesn't oppose Sadhvi Pragya's discharge application in the 2008 Malegaon blast case. Last week, Sadhvi had moved a special NIA court seeking her discharge in the case, citing Bombay High Court's remark that "prima facie no case was made out against her."The Bombay High Court had on April 25 granted bail to Sadhvi Pragya Singh Thakur, accused of plotting the September 2008 Malegaon blast, observing that prima facie there is no case made out against her.At the time, NIA had said it will contest her plea for discharge on the ground that the high court order was limited to the point of granting her bail. But on Friday, the agency told the apex court that it had given a clean chit to Pragya and did not oppose the plea for discharge from the case. timesofindia

Israel plans to build 28,000 new settlement units in occupied Jerusalem over the next decade, Yedioth Ahronoth newspaper reported yesterday.The newspaper reported that this agreement, which includes building 15,000 housing units in the West Bank, would be presented to US President Donald Trump during his upcoming visit to Tel Aviv.The housing ministry and Jerusalem Municipality, which are under the occupation’s control, formulated an agreement considered the largest of its kind, which includes the construction of over 28,000 housing unites in Jerusalem over the next decade. ANKARA:  Turkey has shown the world how generous a society can be by hosting 3 million Syrian refugees, a UN representative in the country told Anadolu Agency.“[…] Our secretary general has mentioned it many times that Turkey is an example. Hosting 3 million refugees is a tremendous strain but it is a show of generosity,” said Irena Vojackova-Sollorano, UN resident coordinator and UN Development Programme resident representative for Turkey since December last year.“We wish that other countries would show such generosity as well,” she added.“We are supporting the government, municipalities, the regions in dealing with the challenges of actually hosting around 3 million refugees.
