New Delhi: A CBI special court on Tuesday granted bail to BJP leaders LK Advani, Murli Manohar Joshi and Uma Bharti in the Babri Masjid demolition case. Bail was granted on personal bond of Rs 50,000 each. The court has, however, rejected the discharge petitions filed by the leaders. The conspiracy charges have been framed against all the 12 accused.The court, which earlier rejected their discharge petition, framed charges against Advani (89), Joshi (83), Union minister Bharti (58) and three others under Section 120 (B) of the IPC (criminal conspiracy). The 3 others are the BJP’s Vinay Katiyar (62), VHP’s Vishnu Hari Dalmiya, who is in his late eighties, and one-time Hindutva firebrand Sadhvi Rithambara (53).The accused had argued against the framing of charges against them, asserting that they had no role in the razing of the mosque and had tried to stop it. Their discharge petitions were rejected by the judge.This was the first time that these leaders had appeared before a court in connection with this case.

Lucknow:Union water resources minister Uma Bharti, who faces charges of criminal conspiracy in the Babri Masjid demolition case, said Tuesday there was no conspiracy but an “open movement” which led to the demolition.“I was present in Ayodhya on Dec.6, 1992, which is no secret. Crores of BJP workers, lakhs of officials and thousands of political leaders participated. It was an open movement like the movement against the Emergency. I don’t see any conspiracy,” Bharti told the media.Bharti said she appeared in the special CBI court out of respect for the court but had “expectations only from God”.“In a matter concerning God, my hopes also rest on God. Lucknow: Hours after BJP stalwarts appeared before a special CBI court for framing of charges in the Babri Masjid demolition case, All Indian Muslim Personal Law Board (AIMPLB) stated that the accused should be framed with charges and not have gotten granted bail.Board member Zafaryab Jilani said, “The grant of bail is not unexpected.In this case whosoever is the accused they have all been granted bail. And in such cases the accused are not seen behind the bars. Advani, Murli Manohar Joshi and Uma Bharati have been in many other similar cases too and were also granted bail then. The main thing required is the framing of charges which the court should have taken up”. Another AIMPLB member Kamal Farooqui stated that serious charges of conspiracy have been framed and justice should be given soon.“It is something that should have happened earlier- but better late than never. After this outcome it has sent several questions on this matter. I personally feel that BJP would be doing a great job to itself if they follow the same kind of principles which they were earlier asking for by the other parties. Lucknow: BJP leader Sakshi Maharaj on Tuesday asserted that no force on earth can stop the construction of the biggest Ram temple in Ayodhya and said he was fortunate to appear in front of a special CBI court in the Babri Masjid demolition case.“I didn’t do anything wrong. In fact, I was fortunate to be part of that as it was a pious thing to do,” he said.“Don’t be mad, there was no Babri mosque. Babar was a foreigner who had nothing to do with India. New Delhi: Underlining that “national interest is at stake”, the Kerala High Court has ordered the DGP of the state to conduct “comprehensive” investigation into cases of ‘Love Jihad’ and have incidents of forcible conversion probed thoroughly.The High Court took a stern view of 2 such cases that came up before it and said that the DGP must supervise and monitor investigations into such instances and bring guilty to the book “as expeditiously as possible”.The court entrusted the DGP with this task when it held as “null and void” the marriage of a 24-year-old Hindu girl, who converted to Islam and wedded a Muslim man in Dec 2016.A bench of Justices K Surendra Mohan and Abraham Mathew asked the DGP to inquire into the role of organisations facilitating such conversions while noting that the top cop should be obligated to do this since the entire state was within his jurisdiction. The police in Kochi resorted to lathicharge and tear gas shells on Monday against several Muslim groups, who laid siege to Banerji road in the city. They were protesting against a Kerala High Court order, nullifying the marriage of a Muslim man and a woman who had converted to Islam.Days after the Kerala High Court nullified the marriage of Hadiya, who converted to Islam and got married to Shafin Jahan in Dec.2006, several Muslim organisations in the state took out a protest march in Kochi on Monday. A division bench of the court nullified the marriage based on a habeas corpus petition filed by her father, a native of Vaikom.According to TV reports, hundreds protesters belonging to various organisations including Muslim Ekopana Samiti, and various student groups took part in the protest. While the agitators were carrying out a march to the High Court, they were stopped by the police at least a km away from the court, near St Albert's College. They shouted slogans there for over half an hour, when the police lathicharged the protesters and used teargas on them. Undeterred by the lathicharge and the tear gas shells, the protesters continued to lay siege to Banerjee road for 20 minutes, following which they dispersed on their own. Hadiya’s marriage was cancelled by the HC after her father had alleged that his daughter was forcefully converted to Islam. New Delhi: Supreme Court has refused to stay the conviction of an IPS officer in the 2002 Bilkis Bano case. A vacation bench of Justices A K Sikri and Deepak Gupta said that there is no urgency for hearing the matter as the convicted officer has already undergone the sentence. The bench, however, listed the matter for hearing in the second week of July, observing the fine is of Rs 15,000 only.IPS officer RS Bhagora, currently serving in Gujarat, has been convicted along with 4 other policemen by the Bombay High Court recently after the trial court had acquitted them.The counsel appearing for Bhagora said if the conviction is not stayed, then he will be terminated from the service as per service rules.The Bombay high court had on May 4 reversed the trial court verdict acquitting Bhagora and others and had upheld the conviction of 11 people (one convict is dead) in the Bilkis Bano gang-rape case. Along with 5 policemen, two doctors were also convicted by the HC.According to the prosecution, on March 3, 2002, Bilkis Bano’s family was attacked by a mob at Randhikpur village near Ahmedabad during the post-Godhra riots and seven members of her family were killed.PTI

Madurai: Madras High Court Bench in Madurai has stayed the operation of Rules 22(b)(iii) and 22(e) of Prevention of Cruelty to Animals (Regulations of Livestock Markets) Rules 2017 notified by the Centre on May 23 banning the sale of cattle for slaughter in animal markets.A Division Bench of Justices M.V. Muralidaran and CV Karthikeyan granted the interim stay for four weeks on a PIL petition challenging constitutional validity of rules.S. Selvagomathy (45), an activist-cum-lawyer based in Madurai, filed PIL petition on grounds that the statutory rules were repugnant to the parent Act itself since Section 28 of the Prevention of Cruelty to Animals (PCA) Act of 1960 specifically states that it shall not be an offence to kill any animal in a manner required by the religion of any community.Claiming that the PCA Act permits slaughter of animals as well as sale of animals for slaughter, the petitioner said the Centre had no authority to extend its rule making power, under the enactment, to the extent of banning the sale of animals in a market for the purpose of slaughter.She contended that the new rules offend the right to freedom of religion guaranteed under Article 25 and the protection of interests of minorities under Article 29 of the Constitution. She said the slaughtering of animals for food and offering sacrifice in religious places were a part and parcel of the cultural identity of most of the communities in the country. Petitioner stated that prohibiting the sale of cattle for slaughter in animal markets amounted to interfering with the right to practice any profession or to carry on any occupation, trade or business as guaranteed under Article 19(1)(g) of the Constitution. Bulandshahr:  About 22 km from Bulandshahr, a bustling town in western UP , is a cattle market where traders and farmers gather to buy and sell every Monday. Locals say the weekly market is a century old. On this Monday, it wears a desolate look."Around 200-300 buffaloes were sold here every day, but now the business is less than a third of what it used to be",  says Syed Aman, a third generation caretaker of the cattle market. The reason, he says, is Centre's new rules, which forbid the sale of cattle for slaughter at animal markets. The markets will now be able to trade cattle only for agricultural purposes such as ploughing and dairy production. The rules have yet to be formally enforced, but their impact is already being felt on the ground. At the market near Bulandshahr, our team met not a single buyer on Monday. The sellers, mostly farmers who came to sell their old or infirm buffaloes to slaughterhouses, slowly vacated the market, disappointed. According to the market's administrators, the ban has disrupted a vital source of earning for the farmer. "A dairy farmer buys a buffalo for around Rs. 40,000 to 50,000 depending on how much milk it can give. Once it becomes infirm he sells it to a slaughterhouse for around Rs. 25,000 to 30,000,"Aman explained, adding that the farmer then "invests a few thousand more to buy another milk-yielding buffalo."The new rules have ruptured this cycle. ndtv

New Delhi: 2 writ petitions were filed in the Kerala High Court on Monday stating that the Centre's notification on cattle slaughter is “contrary to the Prevention of Cruelty to Animals Act, 1960” and it is unconstitutional as the Centre does not have the legislative competence to frame such rules.This petition has been filed by Hibi Eden, the Ernakulam MLA, and K U Kunju Mohammed, a meat shop owner, who is engaged in purchasing of cattle. The petition challenges the constitutional validity of Rule 22 of the newly released rules which in effect prevents purchase of cattle for the purpose of slaughter. The petitioners have contended that the said rules not only violate the Right to Equality, Right to Trade and Profession and the Right to Life, but also encroached upon the legislative field of the state Govt .Another ground which the petition raises to strike down the rule is that the new rule of 2017 does not meet the objective of the parent Act of 1960.News18.com

New Delhi:.Amid strong protest from states like Kerala and West Bengal against the new cattle trade rule, civil society has also expressed serious concern on its likely impact and consequences.Navaid Hamid, President of the All India Muslim Majlis-e Mushawarat, an umbrella body of Muslim organisation termed this new rule against the fundamental rights of a citizen. "There are a number of flaws and problematic provisions in this new rule. It is against the fundamental rights of food, ensured in the Constitution of India. It is also against the freedom of religion as well," Hamid said. Hamid said that if Govt is using such laws on the pretext of cruelty against animal then why it is allowing slaughtering of dogs and goats.He also said that a large number of marginalised population in the country use animal meat as cheap protein.Mohammad Salim Engineer, Secretary General of Jamaat-e-Islami Hind, has strongly criticized the new rule."Govt is directly targeting trade of a particular community and its practice of animal sacrifice - a religious obligation. It is a direct attack on religious freedom," he said. Christian leader and social activist Dr John Dayal also thinks that this rule violates many fundamental rights of countrymen.Dalit leader Bhai Tej Singh, who is president of Ambedkar Samaj Party, thinks the civil society is not speaking as loudly as it should against the new rule."They are allowing human to be killed and talking about animal rights," he added.

New Delhi: Zakir Naik, wanted by NIA on terror charges, has applied for Malaysian citizenship, according to agency sources. Naik has been changing his base quite frequently after the NIA moved the Interpol for issuance of a Red Corner Notice (RCN), international arrest warrant, against him, they said.The preacher, who is believed to have Permanent Residence status in Malaysia, has now sought its citizenship but no decision has been taken so far on his application, the sources said. The Indian government is planning to use its diplomatic channels to frustrate all attempts by the controversial preacher to get citizenship in any country, they said.The Malaysian authorities were aware about terror cases pending against the controversial Islamic preacher, they said.His present place of stay is unknown and it is believed that he has been shuttling between the UAE, Saudi Arabia, African and Southeast Asian countries, the sources said.PTI

New Delhi: NIA is likely to file a FIR in Pakistan's funding of Hurriyat leaders for stone-pelting and other forms of protest in J&K , a case exposed by the exclusive investigation conducted by the India Today TV earlier this month. New Delhi: Delhi High Court today ordered the AAP Govt  and other agencies to carry out eviction orders waiting to be enforced for several years on 990 Waqf Board properties in New Delhi. "There is an order. I do not understand why the authorities are not complying with it. Even the Govt  of Delhi has failed to disclose the steps it has taken in this regard," a bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar said."Law has to be complied with by everyone. You (Govt ) do your job," the bench said, directing that it wanted a status report on the Waqf Board properties being restored to their original status in eight weeks. Court told the authorities to ensure eviction and submit an action-taken report by Aug 8. The court was hearing a public interest litigation or PIL filed by advocate Shahid Ali, which sought eviction of illegal occupants from some 990 Waqf Board properties. PIL said that though the "encroachers" have been ordered to leave, the sub-divisional magistrates concerned have not been enforcing the orders. The court expressed displeasure over the Delhi Waqf Board's submission that it was having trouble getting its properties vacated from unauthorised encroachers. The Waqf Board's counsel said they have also written to the Delhi Govt  in this regard."You are not able to get your properties back. It is so badly encroached," the court said, and told the Delhi Govt  counsel to comply with the law. "You have no idea that you have reduced Delhi to such a mess," it said. The bench asked the Delhi Govt  why a tribunal formed to look into disputes related to Waqf Board properties was not doing anything. The court then asked the counsel for the Revenue Authority, under whom all sub-divisional magistrates of Delhi come, why Waqf laws were framed if there was no intention to enforce them.PTI

NHRC has taken cognisance of the matter and directed its own investigation team to conduct an on-the-spot inquiry and submit a report at the earliest.A delegation consisting of eight relatives, and members of a few NGOs and civil society, had recently submitted a memorandum to the NHRC, seeking its intervention.“A representation has been received from Nazma Bi and nine others, most of them residents of district Ujjain, MP. Islamabad: Pakistan is taking a relook at its position on the Saudi-backed 41-nation Islamic military alliance to be led by its former army chief Gen Raheel Sharif to avoid further straining its relationship with neighbouring Iran, according to a media report on Monday.The Express Tribune reported that Pakistan has decided to follow clear red lines in joining the alliance first announced by Saudi Arabia in 2015.Its decision comes after statements by Saudi authorities at the Arab Islamic-US summit in Riyadh on 20-21 May suggested that the military alliance was meant primarily to counter Iran — a regional rival of Saudi Arabia.The Riyadh summit focused on isolating Iran — which was kept out of the summit — and countering terrorism in West Asia.Pakistani officials insisted that the Pakistan Govt  in-principle agreed to be a part of the initiative if its sole purpose was to fight terrorism. It was believed that the Govt  had joined the alliance when in April it green-lighted Sharif to leave Pakistan to lead the alliance.But the officials said a final decision will be made once the terms of reference (ToRs) of the alliance are finalised. ToRs would be finalised during a meeting of the defence ministers of the participating countries in Saudi Arabia soon.A senior official familiar with the development told the daily that Pakistan would present its set of proposals during the meeting. Iranian-backed Houthi rebels in Yemen have banned the “tarawih” prayers in Sana’a, Gulf News has reported. Prayers are traditionally read in mosques after the usual night prayer during the month of Ramadan.Houthis have also notified Imams to cancel any religious sermons or lectures inside mosques, and forced them to sign a pledge to commit to the ban. It has, apparently, been introduced in a bid to prevent the population praying against the Houthi group and their rule in the Yemeni capital. Tarawih prayers, it is claimed, will only be allowed in Sana’a if supplications are made in favour of the rebels and their allies.Hundreds of religious preachers have fled Sana’a since the Houthis took control of Sana’a. Cyclone Mora has battered Bangladesh, killing at least three people and wreaking havoc in camps housing Rohingya refugees.The tropical storm has forced almost 500,000 people to flee coastal villages.Packing heavy rain and winds, the storm made landfall between Cox's Bazar and the port city of Chittagong early on Tuesday morning.Police said a woman and a man were crushed under trees felled by strong winds in Cox's Bazar.Another woman died of panic, officials said, adding that several thousand houses were damaged in the area, most of them mud-built structures.Community leaders for some 200,000 Rohingya refugees, many of whom live in flimsy makeshift camps having fled persecution in neighbouring Myanmar, said damage to the camps was extensive and there had been no attempt to evacuate them. aljazeera

Yangon (Myanmar): UN on Tuesday appointed noted human rights lawyer Indira Jaising and two other experts to a fact-finding mission to investigate alleged killings, rape and torture by security forces against Rohingya Muslims in Myanmar’s Rakhine state.The mission will be led by Jaising, a Supreme Court advocate, a UN statement said. The other two members are Sri Lankan lawyer Radhika Coomaraswamy and Australian consultant Christopher Dominic.Some 75,000 Rohingya fled the northwestern Rakhine state to Bangladesh after the Myanmar army carried out a security operation last October in response to attacks by Rohingya insurgents on border posts in which nine police officers were killed.Reuters
