Bhopal:The single member judicial commission constituted by Shivraj Singh Chouhan govt to probe the October 30-31, 2016 intervening night Bhopal Central jail-break and death of 8 SIMI men in subsequent police encounter has given a clean chit to the police.In its report, commission headed by retired High Court judge SK Pandey has concluded that "the encounter on October 31, 2016 done by the police was reasonable under prevailing circumstances. The action of the police was in consonance of the provision of law under Section 41 and 46(2)(3) of the CrPc. The use of force resulting in death of the escaped persons was quite inevitable and quite reasonable under prevailing circumstances."The probe panel also concluded that the state government should appoint a committee to examine the security measures to stop repitition of incidents of absconding and escaping of persons from jail. The department of jail has no institution of its own to impart an effective training to its officers and staff.The panel further concluded that on the line of State of Punjab, the MP government should endeavour to provide a training institute to the jail department. The policy of recruitment of officers and staff should also be strictly followed. The jail department should also be made part of the home department so as to maintain better coordination. Earlier on Monday, the much awaited report of judicial probe panel, was tabled in the Madhya Pradesh Assembly.The judicial probe panel was constituted on Nov. 7, 2016 by the state govt to probe the alleged jail break, their subsequent death in alleged encounter with police and related issues. Law Minister Ravi Shankar Prasad has said Article 370 is about the constitutional apparatus as well as the integration of people of J&K with the rest of India. In an interview, Prasad emphasised that the integration is already happening and he sees a “new narrative” here with the youth joining IAS and defence services. New Delhi: Media organisations on Sunday demanded strict action against J&K BJP MLA  Choudhary Lal Singh over his "threatening and intimidating" remarks directed at journalists in the Valley. The Indian Women's Press Corps, Press Club of India, Press Association and the Federation of Press Clubs of India said in a statement that Singh, a former J&K Minister, had warned journalists at a press conference in Jammu to "draw a line". He openly threatened them with consequences and warned them of a fate similar to that of Shujaat Bukhari, the Editor of Rising Kashmir who was shot dead less than a fortnight ago, the statement said.  Bukhari's assassination was condemned by people in general, besides a number of journalist organisations. New Delhi: Ahead of the monsoon session of Parliament, law minister Ravi Shankar Prasad asked Sonia Gandhi, Mayawati and Mamata Banerjee to come out in support of the triple talaq Bill. “Let me make it clear that the Bill is not with regard to religion, mode of worship or faith. It has clear linkage to gender justice, gender dignity and gender equality. SC set it aside as void but still the cases continued. 22 Islamic countries have banned it. India is a secular country. Why are important leaders like Sonia Gandhi, Mayawati and Mamta Banerjee backtracking on it when the issue is purely justice and empowerment of women?” he said.He also said that the government has an “open mind” on the clause in the Bill that allows a third party to file a complaint. He sought to know why the Opposition has issues with the non-bailable clause in the Bill.“That (third party clause) we will take care. On any third party abuse, I have an open mind… And nonbailable simply means you will not get bail from a police station. A magistrate will give bail on terms and conditions,” Prasad said. On why the government has not brought an Ordinance on triple talaq if it is so serious about the issue, Prasad said, “A call was taken that let us take it to Rajya Sabha and let us see the attitude of others. Law Commission to codify personal laws

In what is being perceived as the first step towards bringing a uniform civil code (UCC) for the country, the Law Commission is preparing a report on the codification of personal laws. Personal laws cover matters of property, marriage, divorce, inheritance and succession. Currently, there are different personal laws for Hindus, Muslims, Christians, Parsis and others. A uniform code will mean a set of common personal laws for all citizens. The commission is examining the “defects” in the personal laws followed by various communities to rationalise them. This is likely to pave the way for a common code. The commission is currently perusing the more than 67,000 comments it received so far to a questionnaire on the issue it posted on its website. But, with barely 2 months remaining for the term of the 21st Law Commission under the chairmanship of Justice (retd) BS Chauhan to expire, it is unlikely to submit the final report on uniform civil code by Augt. It recently started its public consultations over the subject. ET was the first to report on May 11 that the commission drew a list of over 30 individuals including eminent lawyers, politicians, former ministers, religious and political institutions and NGOs for consultations. As per available information, the commission held talks with a few Muslim organisations. The discussions will resume in the first week on July. The commission, as reported earlier by ET, is also examining the “practical difficulties” which may create a roadblock for the implementation of a uniform code. economictimes

Bareilly: 2 women in UP have given divorce to their husbands using 'talaq-e-tafweez'. Nisha Hamid divorced Jawed Ansari in presence of two witnesses at a Bareilly court yesterday, 13 years after their 'nikaah' was solemnised.According to advocate Qazi Juber Ahmad (in whose presence the divorce happened), Hamid had alleged she was treated badly by her in-laws. She has even registered a police case in this connection. Hamid had claimed that Ansari was neither divorcing her nor improving ties with her.This, she said, prompted her to exercise her right.Advocate Ahmad said a similar case was also reported from a village under Devrania police station in Bareilly district.Yasmeen alleged Arbaz had abducted her in 2014 and they were later married following a panchayat "ruling". After their marriage, she said, she was harassed by Arbaz for dowry.When contacted, All India Muslim Personal Law Board member Khalid Rashid Farangi Mahali said: "Talaq-e-tafweez is an arrangement under which the husband cannot give triple talaq to his wife in one go. Even if he gives triple talaq in one go, it will not be valid. If a man goes for a second marriage, then the first marriage will cease to exist.""There is a provision in Talaq-e-tafweez that the wife can give divorce to her husband, and there is no restriction that only husband can give divorce to wife. A man can give talaq to his wife after certain time interval. In the model nikaahnama of the personal law board, there is a provision of talaq-e-tafweez.But,this column (in the nikaahnama) is filled only after consent from both the sides.PTI

Ahmedabad: Gujarat High Court on Monday awarded 10 years’ rigorous imprisonment to three convicts in the 2002 Naroda Patiya massacre case, observing that their punishment must be consistent with the brutality of the crime. The three of the total 16 accused were held guilty in an order pronounced on April 20.A Division Bench of justices Harsha Devani and A.S. Supehia awarded 10 years’ rigorous imprisonment to the three convicts in the case — P.J. Rajput, Rajkumar Chaumal and Umesh Bharwad.After their conviction on April 20 by the same court, the trio had sought further hearing on their quantum of sentence on the grounds that they were not properly represented.Pronouncing the sentence, the court gave them six weeks’ time to surrender before the police.In its order on the quantum of sentence, the court observed that the crimes committed by them were against society, and their punishment must be consistent with the brutality with which the crime was committed.SIT and the state government, in their submissions, sought maximum punishment looking at the offence. All the three were acquitted by the special SIT court.However, while hearing appeals, High Court had found them guilty on April 20, even as it upheld the acquittal of 29 others.PTI

The Supreme Court collegium's recommendation for the appointments of two lawyers, one of them a former top court judge's son, as judges of the Allahabad High Court has been returned for the second time by the government citing complaints against them.The two lawyers are Mohammad Mansoor and Basharat Ali Khan. Mansoor is the son of former Supreme Court judge late Saghir Ahmed.Justice Ahmed had headed a working group formed by then Prime Minister Manmohan Singh on Centre-State relations with special reference to Jammu and Kashmir.NDA government had on an earlier occasion returned the file recommending the two names, citing complaints against the candidates. But the collegium reiterated its recommendation, terming the complaints as frivolous.Last month, the recommendation was returned by the government to the collegium for reconsideration, after keeping the matter pending for over two-and-a-half years.PTI

They included Badruddin Ajmal’s son Abdur Rahim Ajmal, who represents the AIUDF, perceived to be a pro-minority party, from the Jamunamukh constituency.Off the list too were Boby Bhuyan Baruah, wife of separatist Paresh Baruah, who has been operating from neighbouring countries, including China, for three decades now, and their sons, Ankur and Akash. Petroleum is the taxation milch cow for the central and the state governments and it is unlikely to be brought under GST any time soon. That's also the view of Rajiv Kumar, Vice Chairman of Niti Aayog.Several senior ministers have demanded that petroleum products—basically petrol and diesel—be brought under the the new taxation regime. But says Kumar: "It (oil) can't be brought under GST. That's because the total state and central taxes on petrol put together are around 90% right now."He said, "I can't see how any state will take a cut so huge as the highest rate under the GST is 28%. A new GST band will have to be opened up—and that will be an enormous exercise."While supporting "in principle" the idea of bringing all items under the new indirect tax system, he said those talking about doing it now have not thought this through.IANS

KABUL: Saudi Arabia's King Salman bin Abdulaziz's recent statement on Afghanistan-Taliban ceasefire has added to the growing optimism in Afghanistan that peace talks with the Taliban could resume.King Abdulaziz on June 20 said, that he has followed with great interest the truce reached over Eid-ul-Fitr between the two sides.The High Peace Council welcomed the king's and the Imam of Kaaba's statement and said it would help the cause. The Kaaba Imam also prayed for peace and stability in Afghanistan."No doubt, Saudi Arabia has influence over the Taliban and their foreign supporters, especially Pakistan. We hope that Saudi Arabia, as the centre of Muslim countries, will put the necessary pressure on the Taliban so that Afghans will witness a peaceful future," Tolo News quoted Sayed Ehsan Taheri, the spokesman for the High Peace Council as saying.Since Saudi shares cordial relations with Taliban, it can help establish peace in both the regions.Taliban still has not officially shown any interest in peace talks with the Afghan government.NATO Chief Jens Stoltenberg on June 21 said the organisation is not going to leave Afghanistan and that Taliban should know they will not win on the battlefield.A negotiating group has also been formed in Washington which will work with the US embassy in Kabul.ANI
