Delhi:AAP has emerged victorious in Delhi Assembly constituencies which witnessed protests against CAA. AAP candidates have won from Okhla, Seelampur, Matia Mahal and Mustafabad with a comfortable margin as the electorate rejected BJP as well as Congress. Overall, Arvind Kejriwal-led AAP is set for a resounding comeback with lead on 62 seats in 70-member Delhi Assembly, while BJP will get limited to 8 seats. Congress has failed to open its account the second time in a row.Even as anti-CAA protests and Shaheen Bagh remained at the centre of the BJP's poll agenda in Delhi, Arvind Kejriwal and his party chose to stay mum on it. And it has paid off.Amanatullah Khan, AAP sitting MLA Okhla - which includes the anti-CAA protest site Shaheen Bagh, has secured a comfortable lead with the second-largest margin of at least 80,000 votes. By 6 pm, he had won 74.1% of all valid votes counted. BJP's Braham Singh was a distant second with 21.97 per cent. After the trends showed him in a comfortable lead, Amanullah Khan said, "People of Delhi have given an electric shock to BJP and Amit Shah. This is the victory of work and defeat of hatred." Okhla constituency, which also constitutes Zakir Nagar, Batla House, Jasola, Kalindi colony, Abul Fazal Enclave, Okhla Vihar, Sarita Vihar, Madanpur Khadar, had seen violence during a police crackdown on Jamia campus on Dec.15. The seat is also hub of Shaheen Bagh protest which is underway for the last 50 days. Okhla seat recorded 58.84 per cent. Seelampur, which had witnessed incidents of violence during a protest against CAA, saw AAP candidate Abdul Rehman won by 36920 votes with BJP's Kaushal Kumar Mishra in the second position. On Saturday, Seelampur constituency had recorded a turnout of 71.2 per cent. Another Muslim-dominated area, next to Seelampur, Matia Mahal also chose Aam Adami Party candidate Shoiab Iqbal over BJP's Ravinder Gupta. AAP candidate's victory margin was over 50,000 votes. Matia Mahal had also witnessed anti-CAA protests. Mustafabad, also in Delhi's northeast and a witness to anti-CAA protests, elected AAP candidate. After trailing for the majority of the day, AAP’s Haji Yunus overtook BJP's sitting MLA Jagdish Pradhan to secure victory with a margin of over 20,000 votes. Indiatoday

Delhi has once again rejected the grand-old Congress in Assembly Elections. After giving Shiela Dikshit a chance to rule for 15 years straight, Delhi seems to be in mind to keep the party at bay for a long time.Congress, which had run a campaign on good olds days, seems to have been forgotten by the national capital as the party has failed to save its deposit on 67 out of 70 seats.Only 3 seats where it managed to score enough votes to save deposits were Gandhi Nagar, Badli and Kasturba Nagar. Even Alka Lamba, who had won Chandni Chowk seat from an AAP ticket in 2015, failed to save her deposit.Tweeting on Delhi poll results, former minister P Chidambaram said, "AAP won, bluff and bluster lost. The people of Delhi, who are from all parts of India, have defeated the polarising, divisive and dangerous agenda of BJP. I salute the people of Delhi who have set an example to other states that will hold their elections in 2021 and 2022."Congress leader Adhir Ranjan Chowdhury also congratulated AAP. "Development agenda has won, I congratulate Kejriwal. Delhi polls have become bipolar, there was nothing for Congress in these polls," Chowdhury said.indiatoday

AAP leader Amanatullah Khan is set to win the seat, and at last count was leading the BJP’s Braham Singh by more than 77,600 votes.“Today’s protest is silent,” read one of the placards at the protest site on Tuesday. “We don’t support any political party. Another placard said the protestors were against police brutality. “We don’t support any political party,” it added.A man said the protestors would not speak to the media as their words could be twisted. “This protest is not about opposing or supporting any one political party,” he added. “We don’t want anyone to get the wrong message today. We won’t allow either the victors or the losers to manipulate us.”Mohammed Wasim, a local resident, told the newspaper that their movement had no connection with any political party. “It’s great that the protestors have decided not to speak today,” he added. “No politician has spoken up for us. Kolkata:  UIDAI has decided against giving permission for setting up special Aadhaar camps in Bengal after a form seeking ‘NPR Receipt/TIN Number’ triggered massive confusion in the state. Though the officials assigned for enrolling and updating Aadhaar details claimed that it was an old form, applicants alleged that they found no clarity in the process as it was given to hundreds of applicants already. The application form seeking NPR number came to light last week when a large-scale protest was organised in Kolkata’s Watgunge area after the news spread regarding the distribution of such forms. An official of the state government said that the form was an old one which was used till 2016.“We asked the UIDAI to stop giving permission for setting up special camps and it responded. From now no such special camp will be held in Bengal,” he said. West Bengal Chief Minister Mamata Banerjee has been a vocal critic of CAA and NRC.Kolkata has 100-odd permanent Aadhaar centres and special camps were organised to avoid the heavy rush of applicants at the permanent centres to either enrol or update Aadhaar. “Not only the people living in Kolkata, but the problem will also be more acute in rural areas in the backdrop of ongoing agitation against amended citizenship law and the NRC,” said the official.    newindianexpress

New Delhi:Bhim Army chief Chandra Shekhar Aazad on Tuesday moved the Supreme Court for a review of its February 7 judgment reiterating the settled law that an individual cannot claim reservation in promotion as a fundamental right. The judgment by a Bench led by Justice L. Nageswara Rao is based on a series of Constitution Bench verdicts, from the Indira Sawhney case in 1992 to M. Nagaraj judgment in mid-2000s.However, Aazad has argued in his review petition that the Februay judgment would "act as a tool in the hands of the oppressors to further oppress and exploit the SC, ST, OBC and the economically weaker sections, causing further marginalisation within the society, thereby defeating endeavor to bring equality between the citizens of this country by the framers of our Constitution particularly those of Baba Sahab Dr. Bhim Rao Ambedkar".The SC Bench of Justices Rao and Hemant Gupta had observed that State governments were not bound to make reservations. The protests have also been replicated in several towns of Rajasthan.Held under the banner of Samvidhan Evum Loktantra Bachao Abhiyan, the protest in Jaipur has drawn the participants from the Walled City neighbourhoods as well as the posh residential colonies. 2 young girls, Nishat Fatima and Hadiya, dressed in the national tricolour, were the centre of attraction at the venue.Though the representatives of various groups have been coming to extend their support to protesters, women have taken the lead in managing the affairs at the venue, situated just outside the Police Commissioner’s office. After initial scepticism, though permission was obtained through official channels, policemen watch the proceedings with interest and have ensured security of the park. The participants have devised creative ways of protest every day and rendered poems, songs and slogans on different themes to make the agitation attractive. Protesters celebrated birthday of Guru Ravidas, mystic poet-saint of Bhakti movement, at the venue on Sunday.Bhim Army leader Neelam Kranti said BJP government at the Centre wanted to divide the citizens on religious lines through CAA and NRC, but the common people would not allow this to happen. “We are here not just to save our Constitution, but also to protect our diversity which has kept the country united after Independence,” she said.thehindu

PSA detentions in J&K: One High Court judge quashes orders, another upholds

Last Friday, a single-judge bench of the Jammu & Kashmir High Court, while rejecting the petition filed by J&K HC Bar Association president Mian Qayoom challenging his detention under the stringent PSA, observed that a court is not a “proper forum to scrutinise the merits of administrative decision to detain a person” and that such a detention is “not based on proof”.But two earlier judgments related to PSA, passed by another single-judge bench of the same High Court, had quashed administrative orders, underlining that preventive detention “cannot be used as an instrument to keep a person in perpetual custody without trial”. Incidentally, Justice Sanjeev Kumar, while scrutinising the detention orders which he subsequently quashed, said though preventive detention involves the detaining of a person without trial in order to prevent him from committing certain types of offences, such “detention cannot be made a substitute for the ordinary law and absolve the investigating authorities”.indianexpress

SC to consider questions of law: May push the envelope on personal law reform, UCC
https://indianexpress.com/article/india/supreme-court-hearing-uniform-civil-code-personal-law-6261570/
New Delhi :The Supreme Court’s decision to consider 7 questions of law touching upon the fundamental right to freedom of religion is set to push the envelope on the idea of reforming personal laws.“We have heard the parties at length. For reasons to follow, we hold that this Court can refer questions of law to a larger bench in a Review Petition,” a 9-judge Constitution Bench said Monday. It did not indicate when a detailed order will be passed. One of the seven questions of law framed by the court itself is on “the scope and extent of the word ‘morality’ under Articles 25 and 26 of the Constitution of India and whether it is meant to include Constitutional morality?” A ruling on Constitutional morality and the extent to which courts can review personal laws and religious rights furthers the legal discussion on the Uniform Civil Code. BJP’s call for “one nation, one law,” or Uniform Civil Code, rests on the reform of personal laws of all religions. Those who endorse UCC idea have highlighted the discriminatory nature of personal laws, especially towards women. In 2018, the Law Commission, headed by retired Supreme Court judge Justice BS Chauhan, had said in a white paper that UCC was “neither desirable nor possible”. Instead, the Commission had recommended amending several personal laws in a “piece-meal fashion” to bring uniformity in personal laws. In 2016, the Law Ministry had asked the Commission to examine the feasibility of bringing in the UCC.indianexpress
