Supreme Court judgements have contributed to ‘Hindu-isation’ of India: Advocate Rajeev Dhavan

https://www.huffingtonpost.in/entry/ram-mandir-supreme-court-babri-masjid-rajeev-dhavan_in_5f228940c5b656e9b097a249?ncid=other_facebook_eucluwzme5k&utm_campaign=share_facebook&fbclid=IwAR3j7IUddcsVkrRSVTpR_1BdmU0m8CsTOK6m1zHIn0dp_qcQ4_ojuniirX4

New Delhi:Supreme Court advocate Rajeev Dhavan, who fought for Sunni Waqf Board and other Muslim parties in the Babri Masjid-Ram Janmabhoomi title suit, said that judgments going back to sixties have given a nod to the idea that India was innately Hindu and that is now fructifying into an affirmation of “muscular nationalism.” In an interview, Dhavan said, "The first judgment on this, in my view, was a judgement in 1966 called Yagnapur Das Ji, where Justice (Pralhad Balacharya) Gajendragadkar indicated that everybody is a Hindu. But there are many denominations and sects that say that we are not Hindus. For temple entry, they may be all Hindus, which were the facts of the case, but he said we must take an expansive view of Hindu to cover everybody. It covered everybody (Jains, Buddhists) except Christians and Muslims. This to my mind was the first judgment of expansive Hindu-isation. The second judgment came in 1995-1996 - argued by Ram Jethmalani — when the SC said that ‘Hindutva’ is a way of life. A 3 judge bench decided that you can appeal to your own religion, but not slander their religion. This in practical terms means a Hindu can go on and on about the greatness of Hinduism as long as he does not tell Christians and Muslims that their religion is bad." The advocate said, "Muslims proved their possession from 1858 because there were land grants by the British. Against the entire evidence it was decided that Hindus were in possession throughout from 1858 even though a judgment of 1886 clearly says Muslims have title and Hindus have a prescriptive right to pray. Hindu side did not have to prove possession at all. 1886 judgment clearly said that they were not owners. The (Ayodhya) judgment is the oddest in the history of the SC." He added, "The court has always expanded its Hinduism to the extent that it has always wanted to. The first judgment is for a mahayana Hinduism. The second one appeals to religion in elections. When you look at the Gujarat riot cases, the SC showed sympathy, but didn’t exactly support the Muslims except on narrow points of law. When judgments co-opt a movement, you find the judiciary responding to, running away from or running on to muscular nationalism. That is how a transformation in the country has taken place. Mild at first and then it becomes stronger because of the rath yatra and Babri Masjid and stronger and stronger and stronger until we reach CAA. So Hindu fundamentalism was always there but its muscularity has suddenly made it offensive. Ex-CJI (Ramesh Chandra) Lahoti (2004-2005), just before he retired, was very concerned about cows not being killed. So he wanted to reverse the 5 judge bench of 1958. The retiring CJI suddenly put cows on the anvil and decided the cow was indeed sacred and we should not kill it. (In 1958, a 5-judge bench in Mohd. Hanif Quareshi & Others vs The State Of Bihar, ruled against a complete ban on cow slaughter, confining it to “useless” cows. In 2005, a 7-judge bench in State Of Gujarat vs Mirzapur Moti Kureshi Kassab ruled in favour of a complete ban, famously stating that the “the value of dung is much more than even the famous Kohinoor diamond”). What was going on in the country was not just Ayodhya. What was going on was that the cow movement, the conversion movement, muscular nationalism was playing out against the minorities at various levels. "huffingtonpost

The wait of centuries is ending today. Millions of people today cannot believe that they are able to see this auspicious day of their lives.”“A grand temple will be constructed for our ‘Ram Lalla’ who had been living in a tent for years. Breaking up and then standing up…Today, Ramjanmabhoomi has been freed from this interference that had been going on for centuries.”“Many people made sacrifices for Ram temple, I pay respect to all of them.”“Shri Ram’s temple will become a modern symbol of our culture, a symbol of our eternal faith, a symbol of our national spirit, and this temple will also become a symbol of the collective resolve power of crores of people. This temple will continue to inspire generations of faith, reverence and resolve.”

Babri Masjid will remain a mosque, SC verdict allowing construction of Ram Temple was unjust, says AIMPLB

https://www.firstpost.com/india/babri-masjid-will-remain-a-mosque-sc-verdict-allowing-construction-of-ram-temple-was-unjust-says-aimplb-8672731.html

All India Muslim Personal Law Board (AIMPLB) asserted that the Babri Masjid will remain a mosque and that the Supreme Court's verdict allowing the construction of a Ram Temple was "unjust and unfair". In a press statement, the organisation's general secretary Maulana Mohammad Wali Rahmani said, "It has always been our position that the Babri Masjid was never built by demolishing any mandir or any Hindu place of worship."The statement further read, "The apex court also accepted that the placing of idols on 22 Dec., 1949, in the masjid was an illegal act. The Supreme Court also accepts in its judgment that the demolition of the Babri Masjid on 6 Dec., 1992, was an illegal, unconstitutional and criminal act. It is indeed regrettable that after accepting all these facts, the apex court in an extremely unjust verdict handed over the land of the masjid to the people who had placed idols in the mosque in a criminal manner and were party to its criminal demolition."AIMPLB noted that according to the Islamic Shariah, "at whichever place a masjid is established, it remains a masjid there forever till eternity. Hence the Babri masjid was a masjid before, is a masjid today and shall Inshallah remain a masjid".

Akal Takht acting jathedar Giani Harpreet Singh on Tuesday shrugged off the invite to bhoomi pujan of the Ram temple in Ayodhya. The invitation, sent by the Shri Ram Janmabhoomi Teerth Kshetra Trust, was delivered by Rashtriya Sikh Sangat, the Sikh wing of pro-Hindutva organisation, RSS on Monday afternoon. When asked if he would be attending the event on Aug.5, jathedar said, “I have not read this invitation.” When told that the contents of the invitation had been published in the papers, he said, “I have not read the papers.” Many are seeing his response as an indication that he won’t go to the event. Rashtriya Sikh Sangat general secretary Sandeep Singh, who delivered the invite, said, “Though we gave the invite on Monday, our national president had sent it to him on Whatsapp 2 or 3 days ago. We can only request his presence. It’s up to him to attend or not,” he added.Notably, the trust planned to ensure the presence of jathedars of all 5 Sikh Takhts at the event. However, there is no possibility of attendance of the jathedars as a considerable section of Sikh community is against it.

BJP Leaders Are Praising Violent Kar Sevaks Who Tore Down Babri Masjid

https://www.huffingtonpost.in/entry/bjjp-leaders-are-praising-violent-kar-sevaks_in_5f2a68bec5b656e9b0a200c9

Prime Minister Narendra Modi, in his speech on Wednesday after laying the foundation stone of the Ram Mandir in Ayodhya, said that he bows down to those who worked to make the dream of the temple come true. Even before his speech, BJP leaders on Twitter had already begin doing so, and in a worrying manner—by openly praising the kar sevaks who tore down the Babri Masjid, along with a video from Dec.5, 1992, a dark day for Indian democracy. While last year, the Supreme Court did allow the building of a Ram temple where the mosque once stood, in 2017, it had also referred to the demolition of the mosque as a crime that “shook the secular fabric of the Constitution”.Not just trolls, office holders of BJP were also celebrating the demolition, which also led to riots that killed thousands.

https://www.huffingtonpost.in/entry/inauguration-modi-ram-temple-ayodhya_in_5f2997f5c5b68fbfc8888150

Dr Faizan Mustafa, Vice Chancellor of NALSAR University of Law, Hyderabad talks about legality and propriety of Prime Minister Modi inaugurating Ram Temple, given that he is the head of govt in a country that calls itself secular, and what secularism means in a country where the state often manages places of worship, religious institutions, and pays the salaries of those who run them.  In an interview, Mustafa said, "Ideally, a Prime Minister of a secular state should not attend publicly any religious event of any religion. Ideally, it should be done only in a private capacity. But legally there is no prohibition on him attending as PM. But I think if the President of India goes there, it would send a very big signal because the President of India represents everyone. "

NEW DELHI: As Prime Minister Narendra Modi laid the foundation stone for the Ram Temple at Ayodhya on the debris of the Babri Masjid on Wednesday (August 5), netizens with secular and democratic minds condemned the act by storming the Twitter with hashtags #BabriZindaHai and #BabriMasjid which trended throughout the day internationally. In a tweet, Labeed Shafi, president of the Students Islamic Organisation of India, questioned the priority of the government of India. He said, “In the middle of a global pandemic which is spreading faster in our country day by, with the economy collapsing all around us and numerous political prisoners locked up in our jails, do we really need to ask why so much time, effort and resources are being spent on organising this one ‘grand’ event to shore up the government’s support among its core ‘bhakt’ base?” Rana Ayyub, celebrated journalist and activist, called the stone-laying ceremony a ‘dystopian’ development. She recalled the demolition of the Babri Mosque, and tweeted, “Aug. 5 will become another infamous date for Muslims in India—a day of increased repression in Kashmir, with the added insult of a grand function in the city of Ayodhya, where Babri mosque’s destruction led to a nationwide attack on Muslims in 1992”.Netizens also blasted the reaction of Indian National Congress towards the Ayodhya event

CHENNAI: As the foundation stone for the Ram Mandir is laid, the question of what a Ram Rajya will imply for the country has constantly been raised. According to BJP MP and Economist Dr Subramanian Swamy, it implies the "implementation of the Indian Constitution, in a nutshell."  Swamy said, "This is true because all the concepts of Ram and what he propagated is there in Directive Principles and the Fundamental Rights and in advocacy of language in the Constitution."Upon being asked if the people who wrote the Constitution of India were 'Ram Bhakts', Swamy insisted vehemently, "Absolutely, Ambedkar was one of the finest. Nehru made him bitter and towards the end of his life, he became very harsh. But if you see his seminar papers at Columbia University in 1915 and subsequently his books, he is perhaps the most articulate spokesman for Hindutva I can think of. I have read every one of those books and that's why I revere him."When asked if he had been invited to the laying of the foundation stone at Ayodhya, he was quick to say, "No."

"The flawed judgment of the Indian Supreme Court paving the way for construction of the temple not only reflected the preponderance of faith over justice but also the growing majoritarianism in today’s India, where minorities, particularly Muslims and their places of worship, are increasingly under attack," said a statement from Pakistan's Foreign Ministry."Since then, OIC [Organization of Islamic Cooperation] has passed numerous resolutions condemning the heinous act of demolishing the centuries-old mosque," the statement said, adding: "Future generations of Muslims would continue to be cognizant of the new illegitimate structure which the Hindutva-driven BJP has campaigned for, and is bent upon constructing as part of its agenda of converting India into a ‘Hindu Rashtra.’ Today’s event in Ayodhya reflected an unrelenting drive in this direction."Anadolu Agency

‘India’s move in J&K illegal’: China on one year of Article 370 abrogation

https://www.hindustantimes.com/world-news/india-s-move-in-j-k-illegal-china-on-one-year-of-article-370-abrogation/story-IcqbXZrz2PuONlbXth4dIJ.html?fbclid=IwAR22jMaEgUfCpjknWDqBCoWuJhCZNKHPVKXalO3_Qc1E56mgvf5lycDJngA

China on Wednesday said that “unilateral” changes India made to the status of the former state of Jammu and Kashmir by splitting it into two separate union territories in 2019 were illegal and invalid.China also called on India and Pakistan to resolve dispute over Kashmir through dialogue and consultations.Responding to a query on the impact of New Delhi’s decision one year later, Chinese foreign ministry spokesperson Wang Wenbin said that Beijing has been closely following the situation in Kashmir.“China follows closely the situation in Kashmir region. China’s position on the Kashmir issue is clear and consistent. This issue is a dispute leftover from history between Pakistan and India. That is an objective fact as laid out by UN Charter, UNSC resolutions and the bilateral agreements between Pakistan and India,” spokesperson Wang said at the regular ministry briefing on Wednesday.“Any unilateral change to the status quo is illegal and invalid. This issue should be properly resolved peacefully through dialogue and consultations between the parties concerned,” Wang said.Wang added that Pakistan and India are neighbours “...that cannot be moved away. Co-existence serves the fundamental interests of both and the common aspiration of the international community.”Wang did not separately mention the areas over which New Delhi and Beijing have disputes in the region.HT

'New Kashmir Looks Frightening': Kashmir Times Editor Anuradha Bhasin On A Year After Article 370

https://www.huffingtonpost.in/entry/article-370-ram-mandir-ayodhya-kashmir_in_5f29850ac5b656e9b0a0c5c4

Day after the Modi government abrogated Article 370 in a shock move, Anuradha Bhasin, the editor of Kashmir Times, approached the Supreme Court. At a time when the then-state of Jammu and Kashmir had been put under complete lockdown — with suspension of telephone services, internet and mobile phone connectivity — Bhasin filed a writ petition demanding the lifting of the restrictions, arguing that it was impossible for journalists to do their jobs under the circumstances. A year later, while the suspended services are now somewhat functional, Bhasin says the future and the present of the media in Kashmir have never been bleaker, with journalists being charged under terror laws and under Public Safety Act. As Prime Minister Modi visits Ayodhya to lay the foundation stone for the Ram Mandir on the anniversary of the abrogation of Article 370, Bhasin said it was a calculated move linked to the assertion of Hindutva. As Jammu and Kashmir, India’s only Muslim majority state which was demoted into two union territories, stuggles to come to terms with the events of the past year, Bhasin said BJP and RSS’s idea of a “new” Kashmir was nothing but frightening. In an interview with HuffPost India, Bhasin looked back on the year that has been, the grim state of the media at the moment, and the anxieties that the abrogation of Article 370 has triggered.

This fear speaks volumes about the true situation on the ground in Kashmir.”

J&K: Most habeas corpus cases dragged on as court slammed govt on due process

JUST 10  months ago, the Srinagar wing of the Jammu & Kashmir High Court was confronted with an unprecedented situation — a staggering 250-plus habeas corpus petitions challenging detentions under the draconian Public Safety Act filed in the first seven weeks post abrogation of the special status of the erstwhile state on August 5, 2019.While the High Court disposed of cases in about 160 petitions filed between August and December 2019, at least 270 habeas corpus petitions remain pending, according to data available on the e-courts platform. But records of cases dealt conclusively by the High Court show that 61 per cent of the cases dragged on over 3-4 hearings, only to be eventually either “dismissed” or “settled” after the court was informed by the government that the petitions had turned infructuous because the detention order under PSA had already been revoked. The writ of habeas corpus is considered one of the most basic protections a citizen is guaranteed under the Constitution against unchecked state power – of taking people into custody without any charges; and the High Courts are specially empowered to issue orders related to this writ, act swiftly, and order the government to produce the detainee before the court and ensure due process.

According to the officials, the facility is located in a sparsely populated area in the north-west of the Kingdom. The Saudi Energy Ministry said in a statement, however, that it “categorically denies” having built the facility in that area, although it acknowledged that it has contracts with China on uranium exploration within certain other areas of the country.“Yellowcake” is a powdered and milled form of uranium ore, an element occurring naturally throughout Saudi Arabia and Jordan. The ore is processed chemically into a fine powder before being put through further processes to enrich the uranium, enabling it to power nuclear energy plants and even be used in nuclear weapons if highly enriched.
