New Delhi:Delhi High Court on Tuesday stayed the order of Central Information Commission directing CBSE to allow inspection of Class X and XII records of union minister Smriti Irani. CIC had last month directed the CBSE to permit examination of textiles minister Smriti Irani’s XII records, overruling the argument that this was personal information. CBSE had challenged the CIC order in Delhi High Court.The order was passed by CIC Sridhar Acharyulu who also gave a similar order with regard to PM Modi’s degree through correspondence from Delhi University.The office of Union minister of textiles and the Holy Child Auxilium School, Delhi, from where she claimed to have passed out, was also directed by the Commission to provide the roll number or reference number of Smriti Irani to CBSE, Ajmer, which possesses the records for the years 1991 and 1993 “to facilitate search from huge records which is yet to be digitized.” Indian Express

Mumbai: Zakir Naik has responded to the ED summons in connection with a money laundering case and said he is willing to give statement via any electronic media facility. "My client is willing and ready to give any statement before you via Skype or any other mode of electronic media to assist you in your investigation," read a letter sent by Naik, founder of NGO IRF, through his lawyer Mahesh Mule. Naik also said that he is an NRI and has not received any summons. He, however, added that his brother was served the summons on Feb.2, asking Naik to appear before the Enforcement Directorate (ED) on Feb.9, and maintained that it could not be construed as proper service (of summons). Naik has also requested the ED to wait for the order of UAPA tribunal before asking him any questions about his now-banned IRF as the ban is being contested. Naik also claimed that he faces an extremely hostile atmosphere in India and under these circumstances, conducting a fair probe against him would be impossible. Mumbai:The High Court Monday reserved its order in the plea filed by Sadhvi Pragya Singh Thakur, an accused in 2008 Malegaon blasts case, challenging rejection of her bail by the NIA court. A division bench of Justice Ranjit More and Justice Shalini Phansalkar Joshi, hearing Thakur’s appeal, has asked her counsel, NIA and the intervenor’s counsel to file written submissions by Feb. 27.While the NIA had earlier stated that it had no objection to the court granting bail to Thakur, advocate BA Desai, lawyer of the intervenor (family of blast victim Nisar Bilal), told the court there was ‘incriminating evidence’ against the accused. Desai concluded his arguments Monday.He said,“There are reasonable grounds to believe that accusations are prima facie true and that Sadhvi was part of several conspiracy meetings prior to the blast.There is voluminous evidence as well as witness statements to prove this.” Desai added that NIA taking over the probe from ATS and conducting a fresh probe, instead of taking ATS’s investigations further, was illegal. He questioned NIA’s probe, which exonerated Thakur in its supplementary chargesheet. “Prosecutor has not acted as the agent of justice in this case. A new inquiry that recently declared Hyderabad scholar Rohith Vemula an OBC and not a Dalit, as certified by a previous probe, went by the testimonials of only 2 people, rejecting the views of 5 others interviewed, an HT investigation has revealed.“This report has been prepared under pressure from the Chandrababu Naidu-led AP govt, which is a close ally of the BJP and PM Narendra Modi,” said Rohith’s brother Raja Vemula.Vemula’s suicide, citing alleged caste discrimination last year at University of Hyderabad, plunged educational campuses across the country into turmoil with Dalit students demanding stern action against those accused of abetting his death, including Union minister Bandaru Dattatreya and university V-C P Appa Rao.“Once Rohith is certified a non-Dalit, those in the dock for allegedly abetting his suicide will not be tried under the more stringent SC/ST (Prevention of Atrocities) Act. It is a simple game to protect the accused,” said Jai Bhimrao, the advocate fighting the case.According to official records, the new inquiry headed by the joint collector of Guntur district interrogated 7 people, 5 of whom said Rohith was a Dalit from the Mala caste. Only 2 said he was a Vaddera or OBC. The commission went with the minority view.Rohith was raised by his mother Radhika, who belongs to the SC Mala caste.But Radhika was adopted by one Anjani Devi, who belongs to the Vaddera OBC community and was the headmaster of a Govt  school in Guntur.Those who said Rohith was a Dalit included his grandfather Venkateshwarulu.Radhika and her two surviving children also backed the claim, besides Anjani Devi.Though she belonged to the Vaddera caste, Anjani Devi told commission that she had adopted Rohith’s mother from a Mala construction labourer. Radhika’s lawyers also cited a Supreme Court ruling which clarified that adoption does not change a person’s caste.Radhika was married to Mani Kumar, a Vaddera, at a young age. She raised Rohith and her other two children alone after separating from her husband.HT

Deljhi:ABVP has reportedly resorted to locking students of Ramjas College inside the campus and stoning after threatening violence against JNU’s Umar Khalid’s presence at a discussion in the college. The act is allegedly still in continuation as this article is being written. According to Facebook posts by Khalid and a few other students of the college, ABVP has surrounded the seminar room, locking both students and teachers inside. It has been reported that the right wing students’ party has resorted to throwing stones. Earlier today, ABVP had disrupted the “Cultures of Protest” conference. The right-wing students’ party was protesting against the presence of JNU’s Umar Khalid. Meanwhile, Khalid, who was not allowed to attend the conference expressed his views on Facebook. Khalid informed that ABVP threatened to disfigure his face to make him unrecognisable. Khalid said that “such open brazennes is possible only because of the institutional impunity ABVP goons enjoy in universities”. Khalid later made another Facebook post saying, “Now, Delhi Police tells the organisers (students and teachers of Ramjas College) that it will not protect me, or the organisers from any attack by ABVP. And according to Delhi Police, organisers will be held responsible for any violence by ABVP. Wow! Such is the state of democracy in our country where attackers are given complete protection and those facing attacks are held responsible for the attacks on them.”

New Delhi:No one appears to be happy with Delhi Police’ investigation to trace the missing JNU student Najeeb Ahmed, the Delhi High Court observed on Monday.“No one, be it the roommate or the family of the student or nine suspected students, appears to be happy with the manner in which the investigation is being carried on,” a bench of Justices GS Sistani and Vinod Goel said. The observation came during the hearing of a habeas corpus plea moved by Najeeb’s mother seeking a direction to the authorities to trace her son who is missing since the night of Oct.14-15 last year.Meanwhile, Delhi Police, represented by senior standing counsel Rahul Mehra, told court that lie-detector tests are going to be “simultaneously conducted” on Najeeb’s roommate, the 9 students who are suspects in the case and some others.PTI

New Delhi: UGC is expected to approve the regulations for setting upof 20 world-class institutions at its meeting scheduled on Feb.22, said sources. If approved, the regulation — titled ‘UGC (Institutions of Eminence Deemed to be Universities) Regulation 2017 — will be the first move in the direction of pruning the Commission’s authority. NDA-II Govt  is planning to restructure UGC, which could include dilution of some of its existing powers and greater autonomy for recognised institutions.Indian Express has learnt that funds meant for the 10 Govt  institutions recognised under this programme will be released directly by the HRD Ministry and not through UGC.

The Delhi High Court has sought the Govt’s response on a plea to immediately halt all future episodes of a TV series ‘Fatah Ka Fatwa’, alleging that it promoted enmity between communities. A Bench of Chief Justice G Rohini and Justice Sangita Dhingra Sehgal also issued notice to the TV channel asking them to respond to the plea.The Bench asked the Ministry of Information and Broadcasting to place before it whether there was any substance in the allegation levelled by the petitioner and fixed the matter for further consideration on May 1. The court issued the direction during the hearing of a public interest litigation by a UP  resident, Hifzur Rehman Khan, who alleged that TV programme hosted by Tarek Fatah, a Canadian writer and liberal activist, tried to promote enmity between Muslims and non-Muslims in the country by giving “baseless arguments about religion”.Asking the court to seize all materials relating to the programme, the PIL urged that the authorities concerned be asked to frame guidelines for telecast of such TV shows, alleging that the host “placed misleading facts” on TV. ‘Fatah Ka Fatwa’ was first aired on Jan.7. — PTI

Bareilly:Bareilly-based religious organisation All India Faizan-e-Madina Council announced a bounty of Rs 10,786 on the head of Islamic scholar and journalist Tarek Fatah, a Canadian national originally from Pakistan. The organization has alleged that Fatah’s programme telecast on a private news channel was “anti-Muslim” and he, being the anchor of the programme ‘Fatah ka Fatwa’, had hurt Muslim sentiments.AIFMC head Moeen Siddiqui Noori also announced a bounty of Rs 5 lakh on the head of the channel’s owner Subhash Chandra.President of Ittehad-e Millat Council, Maulana Tauqeer Raza, said he considered it only a kind of gimmick. “Noori has no credibility among Muslims and he is the only follower of his so-called organisation. He has been in jail for such craziness in the past. This time too, just for sake of grabbing headlines, he has made this kind of statement.”On being asked whether he was not afraid to take the law into his own hands by making such announcements, Noori said, “What Fatah is doing is also illegal, but neither does our Govt  take action against him nor does the court send him to jail. New Delhi:India was the world’s largest importer of major arms in the last five years and its overseas procurement was far greater than that of China and Pakistan, a Stockholm-based think-tank said on Monday.As per latest report of the Stockholm International Peace Research Institute (SIPRI), India accounted for 13% of total global arms import between 2012–16 which is highest among all the countries.The report said while China was increasingly able to substitute arms imports with indigenous products, India remained dependent on weapons technology from Russia, the US, Europe, Israel and South Korea.“India was the world’s largest importer of major arms in 2012–16, accounting for 13% of the global total,” the leading think-tank said.PTI

New Delhi: FMCG major Nestle on Monday said it has taken Rs100 crore hit on sales due to demonetisation and the sector will take another six months to overcome the impact of the Govt ’s move to scarp old high value notes.“We took an impact in November. If you look on overall impact, it would be difficult to put it but roughly the last quarter I met a loss of about of a billion on sales (Rs 100 crore) because of demonetisation,” said Nestlé India chairman and managing director Suresh Narayanan.“As far as we are concerned, in November we took a hit and December was much better. January has been even better and February is also running fairly good,” he said at a roundtable discussion here.PTI

New Delhi:RBI and the Govt  have firmed up plans to launch a new series of Rs 1,000 notes shortly to replace the earlier note of similar denomination that was withdrawn from circulation following the Nov.8 demonetisation announcement, a senior Govt  official has said. RBI, official said, has already started production of the new Rs 1,000 note. According to the official, the initial plan was to introduce the new Rs 1,000 note in January but “it has been delayed due to the pressing need to supply Rs 500 notes”.It is not clear when the new note of Rs 1,000 will be officially introduced into the market. To replace old notes of Rs 500 and Rs 1,000 during demonetisation, RBI had issued new notes of Rs 500 and Rs 2,000 which carried new designs, better security features and the picture of Mangalyaan on the back of the notes.Indian Express

Restructuring labour laws seems to be back as a priority on the agenda of the Union govt.Soon after it assumed office, Modi-led NDA Govt had proposed amending Factories Act, 1948, a law central to regulating work conditions in industrial units. This was one of Union Govt’s first legislative amendments. However, more than two years later, the factories amendment Bill has still not been passed as it has not got the approval of the Rajya Sabha, and there has been slow movement on other proposed legal reforms such as efforts to codify over 44 labour laws into four statutes.But recently, the Ministry of Labour and Employment circulated a 2-page note among central trade unions as a fresh proposal to push amendments to Factories Act. Govt argues that these amendments are necessary to create new jobs and make it easy for businesses to grow. Rohtak: Police has registered a sedition case against an organising member of Jat dharnas in Rohtak for allegedly calling to behead PM Narendra Modi within 24 hours if Jat leader Yashpal Malik asked for it. Sombir, a resident of Jassia village in Rohtak district was booked under sections 124 A (sedition) and 153 A (promoting enmity between groups) of the IPC. “If you say, we will behead Modi but won’t let you down,” Sombir had announced through a microphone addressing a large gathering, in response to an announcement made by Jat leader Malik. However, Malik immediately tried to control the situation by adding that their intentions were to lead a peaceful protest.Sombir has been an active member of the organising teams of Jat dharnas this year. He was also active during the dharnas organised in July last year.He had made the statement on Sunday when the Jat community was observing ‘Balidaan Divas’ in presence of a well-attended gathering.HT

Kolkata: West Bengal Police has charged a BJP leader in a child trafficking case involving an NGO, which allegedly sold infants on the pretext of adoption.Juhi Choudhury, a BJP women’s wing leader has been named in the FIR by the CID, which has arrested two officials of NGO Bimala Shishu Griha -- its chairperson Chandana Chakraborty and chief adoption officer Sonali Mondol -- from Jalpaiguri in north Bengal since Saturday.The busted child trafficking ring allegedly sold two dozen children to different parts of India and countries like US and France, CID sources said.When her reaction was sought, Juhi Choudhury said Chandana Chakraborty had come to her once with complaints against the state Govt  and stated that she was mulling going to court. “I advised her to approach necessary forums. New Delhi: The pronouncement of the Al-Azhar seminary in Cairo, seen as an authoritative voice in the Islamic world, that triple talaq has been undisputed since the era of the Prophet can play into the debate in India over the controversial method of divorce among Muslims.The council of senior clerics in Cairo has unanimously ruled that verbal divorce which "meets all requirements" has been an "undisputed" practice and rejected Egyptian President Abdel -Fattah el-Sissi's suggestion for a legislation to ban the tradition.In the backdrop of the legal challenge to triple talaq in the Supreme Court in India, Al-Azhar view can arm religious conservatives defending the practice and help them argue that it is in conformity with Sharia. According to reports, senior clerics at Al-Azhar, in a carefully drafted statement, said, "Man should document the verbal divorce immediately to serve the rights of the divorcee and children."Amid chorus of women organisations demanding that triple talaq must be abolished and the issue be treated as one of gender justice, the ruling is a recent example of conservative Sunni thought.When contacted, Jamiat Ulama-i- president Maulana Arshad Madani reinforced that "triple talaq in one go is considered to be very bad but if a man resorts to this, it cannot be denied that divorce has happened." "The personal law has existed for hundreds of years and we will not accept any law that will interfere with what is in keeping with Islam," Madani said.AIMPLB member Kamal Faruqui too is clearly against any Govt  "interference" with Muslim personal law. "There is a proper process of divorce for triple talaq in the Muslim personal law wherein there is gap period between each talaq pronounced by the man. In Islam, marriage is a contract and so when the contract is formalised by way of Nikah, both sides can suggest how they would want their separation to happen if it does," Faruqui said.TOI

Panaji: Experts on the subject offered diverse views on Uniform Civil Code (UCC) which proposes to replace personal laws based on customs and traditions in major communities in the country.At an Interactive Dialogue organised by Goa Study Group, in association with the International Centre Goa, former Union Minister for External Affairs and senior Congress leader Eduaro Faleiro suggested constitution of a consultative committee by the Centre.This committee, he said, could comprise of former Supreme Court and high court judges, mainly from the Muslim community, moderate religious scholars and Muslim women representatives who could suggest draft amendments to the present Muslim law, which could then be considered by Parliament. thehindu

New Delhi: Tariq Ahmed Dar, who was convicted in the 2005 Sarojini Nagar blasts for having links with the terror outfit, was granted bail on Monday in a related money laundering case. Dar, however, has been cleared of terror charges.The court said he has been in police custody ever since charges were framed against him and even if the case ends in his conviction, he would have served a large chunk of his sentence by now. Additional Sessions Judge Reetesh Singh said, “He has been in custody in the present proceedings for about five years and five months out of the maximum possible sentence of 7 years. I admit him to bail, subject to him furnishing a personal bond of Rs 25,000.”Judge added, “Directorate of Enforcement reveals that prosecution of Dar for offences under sections 3 and 4 of PMLA are based on the same banking transactions relied upon by the prosecution with respect to his charge under section 17 of UAPA…”He is expected to be released today.indian express

After that, we have had no information about him. Foreign nationals cannot be prosecuted under the Indian criminal law for an offence allegedly committed abroad, a division bench of Justice Abhay Oka and Justice Anuja Prabhudessai held. Rashida Rizvi (58) and her daughter Aabida Rizvi (24), a doctoral student, were arrested at the Delhi international airport in Jan. 2016 when they were returning to their home in the UK after attending a wedding in Allahabad.
